d
T27CCR §21190- Post Closure Land Use:
All proposed postclosure land uses, other than non-irrigated open space, on sites implementing
closure or on closed sites shall be submitted to the EA, RWQCB, local air district and local land
use agency. The EA shall review and approve proposed postclosure land uses if the project
involves structures within 1,000 feet of the disposal area, structures on top of waste, modification
of the low permeability layer, or irrigation over waste.
According to T27CCR, Section 21190, you must notify the EHD prior to making
any changes in land use. The EHD must review and approve all changes in land
use prior to those changes being made. The non-compliance status of the site
would preclude the EHD from being able to approve any changes in Post Closure
Land-use for the site.
As the site owner brining the site into compliance should be a priority. Expanding
existing uses of the site should be considered only after all of the site work has
been completed. This may prevent the EHID from issuing additional time
extensions.
Please contact Jenni Frase, Senior REHS, at (209) 468-9966 if you have
questions regarding this matter.
Robert McClellon, REHS
Program Coordinator
cc: Mac Macanas, California Integrated Waste Management Board
