I unified program with responsibilities for emergency response or training <br /> 2 pursuant to HSC § 25505 . This violation occurred January 1 , 2013 and was <br /> 3 corrected June 5 , 2019 . The violation was cited April 14 , 2017 , <br /> 4 4 . A dispute exists between the Parties regarding the alleged violations . <br /> 5 <br /> 5 , The Parties wish to avoid the expense of litigation and to ensure <br /> 6 <br /> prompt resolution of this matter , and the CUPA wishes to ensure prompt <br /> 7 <br /> compliance with California requirements regarding hazardous materials . <br /> 8 <br /> 9 6 . Jurisdiction over this matter exists pursuant to HSC § 25404 . 1 . 1 . <br /> 10 7 . Respondent waives any right to a hearing in this matter . <br /> 11 8 . This Consent Order shall constitute full settlement of all violations of <br /> 12 Chapter 6 . 95 of the California Health and Safety Code pertaining to the Site <br /> 13 and arising before the Effective Date of this Consent Order . This Consent <br /> 14 Order does not limit the CUPA from taking appropriate enforcement action <br /> 15 concerning any other violations . <br /> 16 <br /> 9 . Respondent neither admits nor denies the violations described above . <br /> 17 <br /> 18 SCHEDULE FOR COMPLIANCE <br /> 19 10 . All alleged violations have been corrected . <br /> 20 PAYMENTS <br /> 21 <br /> 22 11 . Respondent shall pay the CUPA a total of $ 8 , 488 . 00 of which <br /> 23 $ 7 , 500 . 00 is a penalty and $ 988 . 00 is reimbursement of the CUPA ' s costs <br /> 24 through the Effective Date . All additional CUPA costs will be billed at the <br /> 25 current hourly rate . Respondent shall make an initial payment of $ 988 . 00 <br /> 26 within 30 days of the Effective Date . Subsequent payments of $ 2 , 500 . 00 <br /> 27 shall be due February 3 , 2020 , May 1 , 2020 , and August 3 , 2020 for a total of <br /> 28 $ 8 , 488 . 00 . Respondent' s checks shall be made payable to " San Joaquin <br /> 00036862 . 1 . 4 - <br /> CONSENT <br /> 4 - <br /> CONSENT ORDER KEYSTONE RESTAURANT GROUP , LLC <br />
