f <br /> -2- <br /> Federal response to emergency incidents is authorized under Sections <br /> 311 and 504 of the Clean Water Act and Section 7003 of the Resource <br /> Conservation and Recovery Act. Response actions are coordinated <br /> through the National Oil and Hazardous Substances Pollution <br /> Contingency Plan (40 CFR 300). <br /> Requested industry information may not be withheld from EPA on the <br /> grounds that it is considered to be confidential or proprietary. EPA <br /> can protect information deemed to be privileged or confidential, trade <br /> secrets and commercial or financial information (40 CFR Sections 2.203 <br /> and 2.204). Accordingly, please indicate any information which you <br /> consider to be privileged or confidential so that the Agency may take <br /> appropriate protective measures. <br /> The regulations at 40 CFR Section 2.211 preclude EPA employees from <br /> wrongfully using or disclosing any business information which was <br /> obtained during the performance of the employee's official duties. In <br /> addition, EPA employees must take all appropriate action to safeguard <br /> confidential business information from improper disclosure. EPA <br /> employees who violate these requirements are subject to dismissal, <br /> suspension or fines. Criminal action may be taken against EPA <br /> employees who willfully disclose business information.
