Box 1810 <br />Stockton, CA 95201 <br />Re: Your letter dated February 1, 1991 concerning <br />Celotex Waste Material at the Corral Hollow Landfill <br />Dear Mr. Horton: <br />The waste material generated at The Celotex Corporation facility at Tracy, <br />California has not been designated as unsuitable for a Class III landfill as <br />your referenced letter assumes. Numerous analytical tests have been <br />performed and forwarded to the various agencies regarding waste disposal <br />in San Joaquin County. <br />I think everyone agrees based off the test results that the waste material <br />is in fact not a hazardous waste by California definitions, however, the <br />agencies seem to be reluctant based off of available test data to distinguish <br />between a designated waste and an inert, or non-regulated waste. Continued <br />efforts have been made by The Celotex Corporation with little or no assistance <br />from the County of San Joaquin to resolve the classification of the waste <br />material in question. <br />Your letter indicates that a February 28, 1991 date for approval from the <br />various state agencies is required or the County will remove the waste <br />material from Corral Hollow landfill and bill The Celotex Corporation for <br />this expense. If you will refer to my letter dated September 28, 1990, it <br />indicated a cooperative effort by your department in resolving the issue of <br />waste classification and also the comingling, or contamination, of the Celotex <br />waste material at the landfill. I feel these issues should be discussed before <br />you assume the waste material has to be removed. <br />Sincerely, <br />L. M.
