San Joaquin PERM ICIES <br />Stockton, California 95201 <br />Re: S Cipuis`ed Notice and Orda�. <br />Corral Hollow Landfill, SWIS No. 39 -AA -0005 <br />Dear Mr. Padilla: <br />On June 6, 1991, the California Integrated Waste Management Board <br />(Board) received a copy of a Stipulated Notice and Order (STIP) for <br />the "Corral Hollow Landfill", Facility No. 39 -AA -0005, issued by <br />your office to the San Joaquin County Department of Public Works on <br />May 28, 1991. <br />In discussions with representatives from Local Enforcement Agencies <br />(LEA) from around the State, I am aware that confusion has arisen <br />over the use of a Notice and Order (N&O) or a Stipulated Notice and <br />Order (STIP). I am hopeful that the following explanation will <br />clarify this situation: <br />Although the Board's 1/29/91 correspondence, Permit Enforcement <br />Policy (PEP) , mentioned a less than or greater than 90 day time <br />frame, the major difference between the two enforcement orders is <br />as follows: <br />1. A N&O is issued without operator consent. <br />2. A STIP is a contract between the LEA and operator and <br />therefore must be signed by the operator. <br />Pursuant to Title 14 California Code of Regulations (CCR) Section <br />18304(b)(6) and 14 CCR 18304(c), both types of enforcement orders <br />require a signature and a declaration from an authorized officer or <br />employee of the enforcement agency. Both types of enforcement <br />orders describe existing permit violations and direct the operator <br />to take specific corrective actions. Both types of enforcement <br />orders should contain a date -certain for 'completion of each <br />corrective action. You are not required to issue a N&O for those <br />issues requiring less than 90 days to correct and then also issue <br />a STIP for those issues requiring more than 90 days to correct. <br />You are free to choose which enforcement order to use. <br />— Printed on Recycled Paper -- <br />
