Permit Application- Based upon the dates <br />you establish for the above activities, set a <br />date -certain for a new or revised SWFP ap- <br />plication. This can probably be accomplished <br />in less than one year from the date of issuance <br />of the N&O. Set a reasonable time limit. <br />(2) If the Initial Study indicates that any Sig- <br />nificant Impacts will result from project imple- <br />rientation, the preparation of an EIR will be <br />necessary. <br />a. By statute, up to two years from the date <br />of issuance of the N&O must be allowed for <br />development, circulation, and adoption of the <br />final EIR. A preliminary due date of nine <br />months before the Final EIR due date should be <br />targeted for circulation of the Draft EIR. <br />b. "The landfill may receive an average of 1100 cubic <br />yards per day with daily peak loading of up to 1800 <br />cubic yards per day." <br />In accordance with the Board's Permit Enforce- <br />ment Policy (PEP, 11/90), a N&O shall maintain <br />the status auo of a facility and needs to be <br />written to stress an absolute maximum tonnage <br />(yardage) that the facility can accept. The <br />N&O must be very clear in establishing maximum <br />limits which are based upon operating practice <br />over the past year. <br />Staff suggest the phrase "daily peak loading" <br />be clarified as it might be interpreted to <br />indicate interim approval for the landfill to <br />receive up to 1800 cubic yards per day. For <br />the purpose of clarification, staff offer the <br />following as a suggestion: <br />
