Box 2009 ® (1601 East Hazelton Avenue) • Stockton, California 95201 <br />(209) 468-3400 <br />June 24, 1991 <br />Jack Miller <br />California Integrated Waste Management Board <br />1020 Ninth Street, Suite 300 <br />Sacramento, Ca 95814 <br />RE: Corral Hollow Landfill 139 -AA -005 <br />The Environmental Health Division received your letter of 6/11/91 <br />on the stipulated Notice and Order for the Corral Hollow Landfill. <br />This was the sixth Notice and Order EHD has issued in the last 18 <br />months and we have never received any comments until this last one. <br />Our format for all the Notices and Orders have been similar. <br />A Declaration did accompany the Notice and Order but for some <br />reason CIWMB did not receive the Declaration. See enclosure. EHD <br />has always put the name of the responsible party for the facility <br />on every Notice and Order. We do this purposely so a person and <br />not just an entity is responsible. <br />A new SWFP would require the Corral Hollow Landfill to be closed <br />since it would be unpermitted facility. Section 44002 requires all <br />operating facilities to be permitted. EHD does not agree that the <br />Corral Hollow Landfill should be closed just because it has a new <br />operator. EHD statement of a permit revision is correct. <br />This Notice and Order timetable will be based on the completion of <br />CEQA and the permit process. Timetables for CEQA are very <br />difficult to predict, especially since EHD will not be the lead <br />agency. When an CEQA application is accepted a more accurate <br />timetable can be predicted. For your information Section 18304 <br />does not require a timetable to be included in a Notice and Order. <br />EHD has studied the tonnage records for the Corral Hollow landfill. <br />Public Works has agreed to operate under the conditions of the <br />Notice and Order. Enclosed are a few tonnage records for your <br />review. We have always issued Notice and Order with the status quo <br />in mind. <br />Thank you for your advice.
