Board of Supervisors -4- <br />CORRAL HOLLOW SANITARY LANDFILL _ <br />2. AGREEMENT BETWEEN THE CITY OF TRACY AND THE COUNTY OF <br />SAN JOAQUIN FOR THE DISPOSAL OF REFUSE ORIGINATING <br />WITHIN THE LIMITS OF THE CITY OF TRACY <br />This Agreement, in part, establishes that: <br />a. The County will provide a disposal site for <br />the City, fund capital, engineering, and <br />operating costs, and recover these costs <br />through gate fees charged to users of the <br />site. <br />b. The City agrees to utilize the disposal site <br />furnished by the County and pay the gate fees <br />established by the Board of Supervisors for <br />users of the site (this is similar to the <br />agreements between the County and the cities <br />of Lodi, Manteca, and Ripon). <br />On June 15, 1990, copies of the proposed Agreements were <br />submitted to each Board member. Since then, some minor technical <br />revisions were made and are included in the Agreements which are <br />on file with the Clerk of the Board. <br />On June 19, 1990, the Tracy City Council, unanimously approved <br />the Agreements and requested that two changes be made to the <br />Agreement for Purchase of Real Property. The requested changes <br />are currently being reviewed by the City's attorney and County <br />Counsel. During the June 26, 1990 Board meeting, County Counsel <br />will advise the Board in regard to the disposition of these <br />changes. <br />Under the present agreements, both the City of Tracy and the <br />County are equally liable for the CHSL operation. However, since <br />the City operates,the Landfill the County cannot exercise control <br />over the mode of operation. <br />County ownership and operation of the CHSL will provide the <br />County control in meeting State requirements for the closure and <br />long term care of the site. In the event any environmental <br />problems develop at the CHSL, funding for any necessary <br />corrective action would come from gate fees charged to users of <br />the site, which include both City of Tracy and County users. <br />11 <br />
