Board of Supervisors -4- CORRAL HOLLOW SANITARY LANDFILL _ 2. AGREEMENT BETWEEN THE CITY OF TRACY AND THE COUNTY OF SAN JOAQUIN FOR THE DISPOSAL OF REFUSE ORIGINATING WITHIN THE LIMITS OF THE CITY OF TRACY This Agreement, in part, establishes that: a. The County will provide a disposal site for the City, fund capital, engineering, and operating costs, and recover these costs through gate fees charged to users of the site. b. The City agrees to utilize the disposal site furnished by the County and pay the gate fees established by the Board of Supervisors for users of the site (this is similar to the agreements between the County and the cities of Lodi, Manteca, and Ripon). On June 15, 1990, copies of the proposed Agreements were submitted to each Board member. Since then, some minor technical revisions were made and are included in the Agreements which are on file with the Clerk of the Board. On June 19, 1990, the Tracy City Council, unanimously approved the Agreements and requested that two changes be made to the Agreement for Purchase of Real Property. The requested changes are currently being reviewed by the City's attorney and County Counsel. During the June 26, 1990 Board meeting, County Counsel will advise the Board in regard to the disposition of these changes. Under the present agreements, both the City of Tracy and the County are equally liable for the CHSL operation. However, since the City operates,the Landfill the County cannot exercise control over the mode of operation. County ownership and operation of the CHSL will provide the County control in meeting State requirements for the closure and long term care of the site. In the event any environmental problems develop at the CHSL, funding for any necessary corrective action would come from gate fees charged to users of the site, which include both City of Tracy and County users. 11
