MATERIAL FLOWED <br /> ONTO SOIL. REPORTING PARTY AND CONTRACTOR ARE HANDLING THE CONTAINMENT AND CLEAN UP. <br /> OBSERVATIONS: <br /> On 2/24/2020, Robert Lopez, SJC EHD Haz Mat inspector,was on site conducting a haz mat closure inspection and <br /> observed the release of ferrous sulfate fertilizer and possibly other chemicals on the soil next to the opening of a conex box. <br /> Per Robert,the spill location is not secure. Per Carolyn Godwin, Sr.Administrative Analyst with City of Stockton Community <br /> Services, Clean Harbors has been hired to perform the spill clean-up on 2/25/2020. Carolyn confirmed she would attempt <br /> to get the spill location secured by the night of 2/24/2020. <br /> Notify the EHD when the spill clean-up will be performed, in order for the EHD to verify the clean-up is complete. <br /> *Update: On 2/25/2020, I met with Carolyn on site. Observed the fertilizer spill was covered with plastic and coned off. <br /> Observed various waste and waste releases onto the ground inside and outside the old maintenance shop. See violations <br /> observed at the time of inspection on the following pages. <br /> Please be advised that the disposal of any waste[HSC 5411]or disposal of any hazardous waste, or the causing thereof, is <br /> prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC <br /> 25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste <br /> manifesting procedure[HSC 25160(b)(3)]. <br /> Provide a waste/hazardous waste disposal records to the EHD for all clean up debris associated with this spill clean up. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the <br /> corrective actions that have been or will be taken for each violation and any supporting a erwork by 3/26/2020. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> 11 Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> • Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> EHD 25-01 Rev.08/17/17 Page 1 of 6 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
