Failed to determine if a waste is a hazardous waste <br /> OBSERVATIONS:The following was found inside the old maintenance building and was indicated by Carolyn Godwin <br /> to be waste: <br /> 1. Two 5-gallon containers of dried Semi Gloss Acrylic Enamel And House Paint <br /> 2.A black rusted container storing an unknown material <br /> 3. A 5-gallon container of dried Valspar Paint and Primer <br /> 4. A 5-gallon container of American Tradition Acrylic Latex Semi-Gloss <br /> 5.A container that appeared to contain red paint <br /> 6.A florescent lamp in the ceiling light fixture <br /> 7.A broken microwave <br /> 8.A crushed 55-gallon drum. It was unclear if the drum was empty. <br /> 9. Chemical wastes were observed inside the conex box, located on the north side of the maintenance yard, by Robert <br /> Lopez, EHD haz mat inspector, on 2/24/2020. <br /> REGULATION GUIDANCE:Title 22 CCR 66262.11 <br /> Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California <br /> Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one <br /> or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for each waste stated above, and <br /> manage each waste according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or <br /> other knowledge to support your hazardous waste determination. Waste testing must be done using methods <br /> specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined <br /> to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste <br /> generator status. <br /> 2. Facility not maintained to minimize the release of a hazardous waste <br /> OBSERVATION: <br /> 1.
