The container is believed to contain only non-hazardous materials. <br /> OBSERVATIONS: <br /> Spoke with Michael Algots, Hazardous Materials Management, Union Pacific, via phone regarding the brown liquid. Two <br /> containers were stacked on top of each other. Brown liquid was observed on the side of the bottom container so it was <br /> believed that the top container was leaking. Michael Algots hired Patriot Environmental Services(Patriot)to contain the <br /> release and clean it up. Patriot searched through the suspected leaking container(top one)and did not find any evidence of <br /> a discharge. It is currently unknown what the brown liquid on the container is and where it came from. It is suspected that <br /> there was a previous unreported release. Michael Algots had Patriot clean up the liquid on the side of the bottom container <br /> and generated one 55 gallon drum of waste. The waste is going to be profiled by GHD and then be properly disposed of. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> El Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> 11 Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Immediately make a complete hazardous waste determination for the waste that was cleaned off of the container. <br /> Submit all documents showing how the hazardous waste determination was made along with the final disposal records <br /> to the EHD. <br /> ° Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
