Complaint Investigation Summary Report#:5105 <br /> COMPLAINT ID: CON07DK5W Site Location: 1000 E ROTH RD <br /> Activity Summary <br /> Activity Date Recorded by <br /> 08/25/2019 TIME SPENT: 11:42 a.m.-5:48 p.m. ALANIZ <br /> Received a page from San Joaquin General Hospital at 11:42 a.m. A release of <br /> an unknown material occurred at the Union Pacific Intermodal facility, 1000 E Roth <br /> Rd French Camp, CA, 95231. Called the Union Pacific (UP) Emergency phone <br /> number, 888-877-7267, and spoke with the operator. The operator informed me <br /> that the release was discovered on 8-25-2019 and was going to be cleaned up by <br /> Patriot Environmental. The operator also informed me to call Paul Holt, Hazmat <br /> Specialist for UP, 916-540-0496. Called Holt at 11:52 a.m. and discussed the <br /> cleanup. Patriot Environmental, the contractor hired to clean the spill, was in the <br /> process of going through the car looking for the source of the release. Holt <br /> informed me that crystals were observed on the sides of several boxes and that <br /> the car contained peroxide containers. Loup is going to be the responsible party. <br /> Called and updated Muniappa Naidu, Program Coordinator. <br /> Left for the site at 12:18 p.m. Received a call from Holt en route to UP. Pulled <br /> over and called him back at 12:55 p.m. Patriot discovered that container leaking <br /> was one 55 gallon drum of sausage casings containing a salt water brine. When <br /> the liquid dried, salt crystals formed. Called and updated Naidu. I informed Holt <br /> that I was still going to be traveling to the site. <br /> Arrived at the site at 1:18 p.m. While I was signing in, I received a message from <br /> Holt that another spill occurred. <br /> Two releases occurred with the same responsible party. <br /> Release 1: Approximately 2-3 gallons of a salt brine released out of a 55 gallon <br /> drum located in car EMHU 200166. The release could also be seen on the <br /> container below it(EMHU 206014). The UP spill report number for this release is <br /> 2019-08-25-063 MMR. <br /> Release 2: Approximately 1 gallon of battery acid and 2-3 gallons of a hydraulic oil <br /> were released from several containers located in car EMHU 263361. The release <br /> sprayed onto the side of another container(EMHU 249268). The UP spill report <br /> number for this release is 2019-08-25-111 NJW. <br /> On site were Patriot employees Joseph McGuffin, Emergency Response <br /> Manager, and Derek Smith, Field Supervisor. <br /> Regarding release 1 where white crystals were observed in car EMHU 200166: <br /> Patriot Environmental searched through the entire car containing white crystals <br /> and found the source of the release to be a salt water brine from a 55 gallon drum <br /> containing sausage casings. The car also contained peroxides. According to <br /> Patriot, all of the peroxide containers were intact with no signs of a release. The <br /> crystals that were observed from the brine release were wiped up using cloths <br /> including any material that was observed on the car below it (EMHU 206014). One <br /> 10 gallon plastic bag of wipes was generated. The waste is going to be disposed <br /> of as non-hazardous and thrown away at the Patriot Environmental Yard. When I <br /> arrived on site, the cleanup had been completed. I looked inside container EMHU <br /> 200166 and did not see any signs of a release. <br /> I asked McGuffin how the hazardous waste determination was made. He replied <br /> that the pH of the crystals was between 6 and 7. In other words, it was just salt <br /> water that spilled. I contacted Holt to ask if he had an SDS for the brine. He did <br /> not. I asked McGuffin where the sausage casings were coming from and going to. <br /> He replied that they were coming from Chicago (address unknown) and going to <br /> Silva Sausage Co., 5935 Rossi Ln, Gilroy, CA 95020. Looked up the facility in <br /> CERS to see if they had any information on the salt water brine. They did not <br /> have a CERS account. <br /> At this time I received the contact information for the responsible party via email <br /> from Holt. The company is Loup Logistics. The address is 1400 Douglas Street, <br /> Omaha, NE 68179. The contact person is Chris Calabro (1-800-262-2549). <br /> Called Calabro and discussed the releases and the EHD process with him. I <br /> informed him that the EHD does charge for time spent and that he would be <br /> receiving a notice to abate. I asked Calabro if he had an SDS. He said he did not <br /> and that he would have to discuss the waste disposal with the person that would <br /> be handling the incident, Danny Meyer.
