Determined that James M. Sullivan, [(408) 354-8040, EASTER <br />225 N. Santa Cruz Ave. Los Gatos, CA 95030], is attorney of record for the <br />probate of Timothy Ronyak's Estate. Called and made contact with Mr. Sullivan <br />who stated that the property is still in probate and that Ms. Patricia Ronyak "does <br />not have a penny to her name." Mr. Sullivan stated that Ms. Ronyak cannot afford <br />to clean-up the property. Mr. Sullivan stated that, because of COVID, the clerk in <br />the probate court has been sitting on the probate case for about five months and <br />has not set a date to finalize the proceedings and allow Ms. Ronyak to sign off on <br />the property. <br />Mr. Sullivan stated that the City of Manteca is in the process of condemnation on <br />the front 3.5 to 4.5 acres of the property. <br />Mr. Sullivan further stated that he was unaware of the truck parking and <br />continued dumping, and that he would be contacting the Sheriff's Department to <br />have the people removed from the property. <br />-Mr. Sullivan is aware of the person Larry Dargitz that represents himself as a <br />family friend representing Ms. Ronyak but he stated that he has no authority to <br />speak for her. <br />I requested a copy of an Environmental Assessment from June of 2019 when Mr. <br />Sullivan mentioned it, and he provided it and asked if the department would have a <br />look at it. <br />I informed Mr. Sullivan that if no progress was made to stop the illegal dumping <br />and clean-up the property that the department would have it designated as an <br />illegal dumpsite. <br />08/20/2020 Reviewing Phase ll Site Assessment: 19043 and 19051 McKinley Ave., Manteca, EASTER <br />CA. <br />08/21/2020 Finished reviewing Phase II Site Assessment: 19043 and 19051 McKinley Ave., EASTER <br />Manteca, CA. <br />-Summary of Recognized Environmental Conditions: <br />Suspected current use of the land as a landfill. The United States <br />Environmental Protection Agency database list the properties at 19051 and 19043 <br />McKinley Avenue, APN #24140018 and 214140020, as a solid waste landfill. <br />Trash burning was observed onsite during site reconnaissance. <br />The material used to fill the former pond on the property is unknown. <br />Former and current use of the western portion of the property for intermittent <br />storage since at least 1982. <br />Former agricultural use of the land. <br />Current and historical use as vehicle storage near the center of the property. <br />Investigation. Thirty soil borings were advanced across the property at depths of <br />0.5 to 15 feet to collect soil and groundwater samples. Eight borings were <br />advanced for onsite, soil vapor analysis using mobile laboratory, and a handheld <br />gas monitor to test for methane. <br />-Summary of findings: <br />Soil Sampling. No VOCs were detected, above regulatory screening levels of <br />hazardous waste, in soil vapor. The handheld gas monitor did not detect <br />methane. <br />Soil Sampling. Chromium was detected in five soil samples above the SLTC of <br />50mg/kg. Therefore, chromium levels on the site may exceed the hazardous <br />waste threshold. <br />Groundwater Sampling. Low levels of VOCs were detected in the groundwater <br />samples (4). None of the VOCs detected exceeded MCL or ESL except for TPHd <br />that exceeded the tier 1 ESL for TPH. <br />Soil Vapor Sampling. No VOCs or methane was detected. <br />5105.rpt <br /> Page 3 of 4
