Determined that James M. Sullivan, [(408) 354-8040, EASTER 225 N. Santa Cruz Ave. Los Gatos, CA 95030], is attorney of record for the probate of Timothy Ronyak's Estate. Called and made contact with Mr. Sullivan who stated that the property is still in probate and that Ms. Patricia Ronyak "does not have a penny to her name." Mr. Sullivan stated that Ms. Ronyak cannot afford to clean-up the property. Mr. Sullivan stated that, because of COVID, the clerk in the probate court has been sitting on the probate case for about five months and has not set a date to finalize the proceedings and allow Ms. Ronyak to sign off on the property. Mr. Sullivan stated that the City of Manteca is in the process of condemnation on the front 3.5 to 4.5 acres of the property. Mr. Sullivan further stated that he was unaware of the truck parking and continued dumping, and that he would be contacting the Sheriff's Department to have the people removed from the property. -Mr. Sullivan is aware of the person Larry Dargitz that represents himself as a family friend representing Ms. Ronyak but he stated that he has no authority to speak for her. I requested a copy of an Environmental Assessment from June of 2019 when Mr. Sullivan mentioned it, and he provided it and asked if the department would have a look at it. I informed Mr. Sullivan that if no progress was made to stop the illegal dumping and clean-up the property that the department would have it designated as an illegal dumpsite. 08/20/2020 Reviewing Phase ll Site Assessment: 19043 and 19051 McKinley Ave., Manteca, EASTER CA. 08/21/2020 Finished reviewing Phase II Site Assessment: 19043 and 19051 McKinley Ave., EASTER Manteca, CA. -Summary of Recognized Environmental Conditions: Suspected current use of the land as a landfill. The United States Environmental Protection Agency database list the properties at 19051 and 19043 McKinley Avenue, APN #24140018 and 214140020, as a solid waste landfill. Trash burning was observed onsite during site reconnaissance. The material used to fill the former pond on the property is unknown. Former and current use of the western portion of the property for intermittent storage since at least 1982. Former agricultural use of the land. Current and historical use as vehicle storage near the center of the property. Investigation. Thirty soil borings were advanced across the property at depths of 0.5 to 15 feet to collect soil and groundwater samples. Eight borings were advanced for onsite, soil vapor analysis using mobile laboratory, and a handheld gas monitor to test for methane. -Summary of findings: Soil Sampling. No VOCs were detected, above regulatory screening levels of hazardous waste, in soil vapor. The handheld gas monitor did not detect methane. Soil Sampling. Chromium was detected in five soil samples above the SLTC of 50mg/kg. Therefore, chromium levels on the site may exceed the hazardous waste threshold. Groundwater Sampling. Low levels of VOCs were detected in the groundwater samples (4). None of the VOCs detected exceeded MCL or ESL except for TPHd that exceeded the tier 1 ESL for TPH. Soil Vapor Sampling.
