Impact Discussion:
<br />a) The California Department of Fish and Wildlife Natural Diversity Database lists buteo swainsoni (Swainson's Hawk) as
<br />rare, endangered, or threatened species or habitat located on or near the site for the proposed project. Referrals have
<br />been sent to the San Joaquin Council of Governments (SJCOG), the agency responsible for verifying the correct
<br />implementation of the San Joaquin County Multi -Species Habitat Conservation and Open Space Plan (SJMSCP), which
<br />provides compensation for the conversion of Open Space to non -Open Space uses which affect the plant, fish and
<br />wildlife species covered by the Plan. Pursuant to the Final EIR/EIS for SJMSCP, dated November 15, 2000, and certified
<br />by SJCOG on December 7, 2000, implementation of the SJMSCP is expected to reduce impacts to biological resources
<br />resulting from the proposed project to a level of less -than -significant.
<br />SJCOG responded in a letter dated March 8, 2021, that, as the applicant is requesting a General Plan Map Amendment
<br />and Zone Reclassification with no ground disturbance, any subsequent development applications on the project site will
<br />be subject to participation in the SJMSCP. Therefore, these application requests are not expected to have any impact
<br />on sensitive species but subsequent commercial development projects will be subject to the SJMSCP in order to reduce
<br />impacts to biological resources to a less than significant level.
