Impact Discussion:
a) The California Department of Fish and Wildlife Natural Diversity Database lists buteo swainsoni (Swainson's Hawk) as
rare, endangered, or threatened species or habitat located on or near the site for the proposed project. Referrals have
been sent to the San Joaquin Council of Governments (SJCOG), the agency responsible for verifying the correct
implementation of the San Joaquin County Multi -Species Habitat Conservation and Open Space Plan (SJMSCP), which
provides compensation for the conversion of Open Space to non -Open Space uses which affect the plant, fish and
wildlife species covered by the Plan. Pursuant to the Final EIR/EIS for SJMSCP, dated November 15, 2000, and certified
by SJCOG on December 7, 2000, implementation of the SJMSCP is expected to reduce impacts to biological resources
resulting from the proposed project to a level of less -than -significant.
SJCOG responded in a letter dated March 8, 2021, that, as the applicant is requesting a General Plan Map Amendment
and Zone Reclassification with no ground disturbance, any subsequent development applications on the project site will
be subject to participation in the SJMSCP. Therefore, these application requests are not expected to have any impact
on sensitive species but subsequent commercial development projects will be subject to the SJMSCP in order to reduce
impacts to biological resources to a less than significant level.
PA -2100019 and PA -2100020 — Initial Study
N
Planning Commission Staff Report, PA -2100019, 20 (GP, ZR) 13
Environmental Review
Potentially
Less Than
Significant with
Less Than
Analyzed
Significant
9
Mitigation
Significant
9
No
In The
Impact
Incorporated
Impact
Impact Prior EIR
IV.
