Tribal Cultural Resources. <br />a) Would the project cause a substantial adverse <br />change in the significance of a tribal cultural <br />resource, defined in Public Resources Code section <br />21074 as either a site, feature, place, cultural <br />landscape that is geographically defined in terms of <br />the size and scope of the landscape, sacred place, <br />or object with cultural value to a California Native <br />American tribe, and that is: <br />i) Listed or eligible for listing in the California <br />Register of Historical Resources, or in a local ❑ <br />register of historical resources as defined in Ix <br />Public Resources Code section 5020.1(k), or <br />ii) A resource determined by the lead agency, in its <br />discretion and supported by substantial <br />evidence, to be significant pursuant to criteria set <br />forth in subdivision (c) of Public Resources Code <br />Section 5024.1. In applying the criteria set forth ❑ ❑ ❑ ❑ <br />in subdivision (c) of Public Resource Code <br />Section 5024.1, the lead agency shall consider <br />the significance of the resource to a California <br />Native American tribe. <br />Impact Discussion: <br />a) The proposed applications are for a General Plan Map Amendment and Zone Reclassification. A referral was sent <br />to the United Auburn Indian Community (UAIC), North Valley Yokuts Tribe, the California Valley Miwok Tribe, and <br />the Buena Vista Rancheria for review. The UAIC sent a response letter dated March 11, 2021, which stated that <br />the project area was culturally sensitive and has the potential for the presence of Tribal Cultural Resources (TCR). <br />UAIC requested a consultation under AB 52, and the following mitigation was proposed for any subsequent <br />commercial development projects: <br />A Tribal Cultural Resource Awareness brochure shall be provided to all construction personnel, and a training shall <br />be developed in coordination with interested Native American Tribes for all personnel involved in the project <br />implementation. <br />A minimum of seven (7) days prior to the beginning of earthwork or other soil disturbing activities, the applicant shall <br />notify the United Auburn Indian Community (UAIC) with the proposed earthwork start -date and a UAIC Tribal <br />Representative or Tribal Monitor shall be invited to inspect the project site, including any soil piles, trenches, or <br />other disturbed areas, within the first five (5) days of groundbreaking activity, or as appropriate for the type and size <br />of the project. <br />If any suspected Tribal Cultural Resources (TCR) are discovered during ground disturbing construction activities, <br />all work shall cease within 100 feet of the find. A Tribal Representative from culturally affiliated tribes shall be <br />immediately notified and shall determine if the find is a TCR pursuant to Public Resources Code Section 21074. <br />The Tribal Representative will make recommendations regarding the treatment of the discovery. Preservation in <br />place is the preferred alternative under CEQA and UAIC protocols, and every effort must be made to preserve the <br />resources in place, including through project redesign.
