INSTRUCTIONS <br /> Special Purpose Commercial Modular <br /> Mobile Food Preparation Unit Checklist <br /> CA Code of Regulations, Title 25, Article 3.5 <br /> CA Health and Safety Code, Part 7, California Retail Food Code <br /> The attached checklist was developed for District Representatives (DR) and others to use as a <br /> guideline when inspecting Special Purpose Commercial Modular' (SPCM) Mobile Food Preparation <br /> Units. SPCMs that serve as Mobile Food Preparation Units are constructed in accordance with two <br /> sets of standards under two separate sets of statutes. One set is under the Department of Housing <br /> and Community Development(HCD), T25 CCR Art. 3.5. The other set is under the Department of <br /> Public Health (DPH), California Retail Food Code (CRFC). Generally, the DPH statutes mirror HCD <br /> regulations, however when in conflict, in most cases the DPH regulations preempt HCD regulations. <br /> The DPH statutes noted in the following checklist are for informational Purposes only and not <br /> intended for a DR to cite violations of the DPH statutes as HCD does not have this authority. <br /> However, a DR may make the owner or operator of the SPCM aware of any violations discovered that <br /> might be in violation of DPH statutes. <br /> Mechanical, plumbing or electrical issues not addressed in T25 CCR Art 3.5 are found in T24, <br /> CBSCode as adopted in HSC 18028 (effective 03.31.12). The referenced and adopted parts of the <br /> CBSCode that pertain to SPCMs are: <br /> • Part 2 —CA Building Code, Chap 11B (Accessibility—Public Use) <br /> • Part 3 —CA Electrical Code <br /> • Part 4—CA Mechanical Code <br /> • Part 5 —CA Plumbing Code. <br /> Definition—"Special purpose commercial modular" means a vehicle with or without motive power,designed and <br /> equipped for human occupancy for industrial, professional, or commercial purposes, which is not required to be moved <br /> under permit,and shall include a trailer coach.The following are elements of the definition: <br /> (1) Not required to be moved under permit,- <br /> (2) <br /> ermit;(2)"A vehicle; <br /> (3)With or without motive power, <br /> (4) Designed and equipped for human occupancy for industrial, professional, or commercial purposes; <br /> (5)Includes a trailer coach <br /> "Vehicle"is a device by which any person or property may be propelled, moved, or drawn upon a highway, <br /> excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks. <br />
