In accordance with that a9reemant, the <br />Applicant has agreed to: <br />1) SJMSCP Incitlental Take Minimization Measures and mitigation requirement: <br />1. Incidnnxal Take Min zarion Measures (ITMMs) will be ued to the project and must be signed by the <br />pr jeer applicant pri rtto any gro and disturbance but no la[m then s x (6) months from r eipt ofthe ITMMs. <br />If ITMMs not signed within s on[hs, [he applicant must reapply for SJMSCP Coverage. Opon eip[ <br />ofsignetl ITMMs from pr jeer applicant, SICOG, Inc, stef£will sign the ITMMs. This is the effectiverdate <br />of the ITMMs. <br />2. Under no circumstance shall ground tlisturbence occur without compliance and satisfaction of the ITMMs. <br />3. Upon of Fully a cutetl ITMMs and pri r to any ground disNrbflnce, the protect applicant must: <br />a. Post a bond for payment of the applicable SJMSCP fee ing [he entirety of the p jeer acreage <br />beivg covered (the bontl shoultl be valid for no longor than ar6 month period); or <br />b. Pay the appropriate SJMSCP fee for the entirety ofthe project acreage being covered; or <br />Dedicate tend in -lieu of fees, either as conservation easements or fee title; or <br />d. Purchase approved mitigation bank credits. <br />4. Within 6 months from the effective date of the ITMMs or rssuance of n bvildittg permit, whichever occurs <br />first, Che project applicant mus[: <br />Pay the appropriate SJMSCP for the entirety ofthe pr jeer acreage being covered; or <br />b.
