In September 2016 , approximately 5 , 800 gallons of waste oil was removed from two of <br /> the tanks and a plug was placed in the fill ports . The two remaining tanks were observed to be filled with <br /> water. No additional actions were taken to address the two waste oil tanks . <br /> VIOLATIONS/OBSERVATIONS : <br /> ' HSC 25298 - No person shall abandon or close or cease operating an underground storage tank ( UST) system without <br /> complying with the closure requirements . A person closing the UST system shall : 1 ) demonstrate that all residual amounts <br /> of hazardous substance have been removed and properly disposed of, 2 ) adequately seal the tank system , 3 ) provide for <br /> and carry out necessary maintenance of the tank system , 4) demonstrate that the site has been investigated to determine <br /> if there are any present or past releases , and that remedial actions have been taken . <br /> *CCR Title 23 section 2670 - Permanent closure requirements shall apply to USTs in which the storage of hazardous <br /> substances has ceased and the tanks will not be used within the next 12 consecutive months . <br /> CORRECTIVE ACTIONS/ORDER : <br /> Immediately provide adequate and complete documentation regarding previous actions taken to properly <br /> address these tanks , or obtain a permit from the EHD for proper closure of any underground tanks at this <br /> site . <br /> A UST Removal Permit Application can be obtained at : https : //www. sjgov . org/department/envhealth/forms <br /> CORRECT BY : Immediately <br /> FAILURE TO COMPLY WITH THIS NOTICE <br /> MAY RESULT INFORMAL ENFORCEMENT ACTION <br /> INSPECTED BY: PRINT NAME : Stacy Rivera <br /> y1%rWrTURE ENVI 1 AL HE L TAFF <br /> RECEIVED BY : DATE : 5/3/202 <br /> SIGNAT4#r6FOWNER/OPE TOR <br /> hof � T6 <br /> EHD 48-042 Rev, 07/16/19 NOTICE TO ABATE <br />
