Ms. Margaret Quiroga - 2 - June 24, 2021
If you are not the responsible party for the Site, you must submit a letter detailing your
justification, along with any supporting evidence within thirty (30) days of the date of this
letter; July 24, 2021.
All documentation should be sent electronically to the contact below:
State Water Board Local CUPA
Mr. Douglas McDevitt Mr. Muniappa Naidu
UST Enforcement Unit Program Coordinator
Office of Enforcement San Joaquin County Environmental
State Water Resources Control Board Health Department
801 K Street, Suite 2300 1868 East Hazelton Avenue
Sacramento, California 95814 Stockton, California 95205
douglas.mcdevitt(a-)waterboards.ca.gov mnaidu(asicehd.com
The State Water Board prefers that you submit the requested documentation
electronically in order to reduce paper use, increase efficiency, and provide a more
effective way for our staff, the public, and interested parties to view documents in
electronic form.
The UST regulatory program has identified the single-walled UST systems at your
property as non-compliant with the requirements of Health and Safety Code
section 25291(a)(1)-(6).
(6) Single-walled containers do not fulfill the requirement of an
underground storage tank providing both a primary and a
secondary containment.
Additionally, Health & Safety Code, chapter 6.7, section 25292.05, requires closure of
tanks that do not meet the requirements above, on or before December 31, 2025.
The State Water Board has several funding programs that may be able to assist you in
the removal of the USTs on your property. If you never used the tanks on your property,
you may be eligible for the Orphan Site Cleanup Fund, which could assist with the cost of
tank removal and necessary cleanup. If you are a small business, there are grants and/or
loans available through the Removing, Replacing, and Upgrading Storage Tank (RUST)
Grant Program. If a release is discovered during UST removal, reimbursement for site
cleanup is available through the UST Cleanup Fund. Please contact us to inquire about
eligibility requirements for these programs.
Contractors performing UST removal work should also hold a Hazardous Substance
Removal Certification. To verify the licenses of a particular contractor or to identify
contractors in a certain area, you can:
• use the search function on the Contractor's State License Board's website at-
https://www2.cslb.ca.gov/OnlineServices/CheckLicensel I/ZipCodeSearch.aspx;
• identify UST contractors in the Petroleum Equipment Institute directory at:
https://digital.peiAournaI.org/peimournal/peidirectory 2021/MobilePagedReplica.acti
on?pm=2&folio=78#pg80;
