OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented) that employees who handle hazardous waste were properly trained, based on the following observations: 1. The following waste items were found inside a container labeled as State Managed Waste/Toxic(ST) Hazardous Waste (see photos IMG 8442-3): -A 6.75 oz bottle of Formula 10.0.6 So Totally Clean was identified as a Flammable Liquid And Solid on a hand-held scanner, which was used by Mercedes Alegre, Prestige Manager, to scan the item (IMG 8448-50). -A 4 oz bottle and a 1 oz bottle of Urban Decay All Nighter Makeup Setting Spray were labeled as flammable(IMG 8443). -A 5 oz aerosol can of KeraColor Color Me Clean Dry Shampoo, which Mercedes stated should have been placed in the Flammable Gas (FG) Hazardous Waste container(IMG 8451-3). 2. The following waste items were found inside a container labeled as Oxidizer(OX) Hazardous Waste (IMG 8471, 8473): -At least two 2 oz bottles of Redken SEQ Gloss were identified as Flammable Liquid And Solid (FL) on the scanner (IMG 8475-6). 3. An open can of Benefit Wax & Glow Facial Wax, which appeared used and contained paper towels, was found inside a plastic bag on the floor next to the hazardous waste storage area(IMG 8482-5).When asked how the can of wax would be managed, Mercedes said wax that can no longer be sold is to be placed in the ST Hazardous Waste container, and she placed the plastic bag with the can of wax inside a ST Hazardous Waste container(IMG 8486-7). 4. The waste items listed below were found inside a container that was labeled "Haircolor And Developer Only" and "OX Hazardous Waste" and observed inside the salon/hair washing area of the facility (IMG 8488-90).According to Mercedes, items placed into this container are removed and sorted into the appropriate Hazardous Waste containers in the hazardous waste storage area nightly. -A6 oz aerosol can of Paul Mitchell Thermal Protection Hairspray labeled as flammable (IMG 8491-3). -Four 33.8 fl oz bottle of Red Ken hair conditioner(IMG 8494, 8497).According to the Ulta Potentially Hazardous Waste Management poster posted in the hazardous waste storage area, hair conditioners are to be placed in an ST Hazardous Waste container(IMG 8419). -A 9 oz aerosol can of Wella Stay Essential hairspray (IMG 8497). -At least two 2 oz bottles of Redken SEQ Gloss, which were previously identified as Flammable Liquid And Solid on the scanner(IMG 8496). -At least three 5.5 oz bottles of Redken Chemistry Shot Phix Phase Sealer, which were not given a hazardous waste classification on the scanner when scanned (IMG 8495-6).The scanner stated "Action: Destroy in Field," when the item was scanned. Mercedes stated that when the scanner says"Destroy in Field" for an item, but does not state which hazardous waste container the item belongs in, employees place the item in the ST Hazardous Waste container. 5. A container labeled as Flammable Gas (FG) Hazardous Waste and marked aerosol for the physical state contained the waste items listed below, which were not flammable gases, nor aerosols (IMG 8454-5): -A Red Carpet RCM Color Dip Starter Kit was identified as a Flammable Liquid and Solid on the scanner(IMG 8456). -A 3.4 oz Ralph Lauren fragrance/perfume was identified as a Flammable Liquid and Solid on the scanner(IMG 8457).
