OBSERVATION: The following incompatible wastes are stored in way that is not in compliance with the regulatory sections listed below: 1.The waste items listed below were found in a silver container observed in the Ulta Salon and labeled with the words"This trash can is for Salon color tubes only,""Empty Daily,""Hazardous Waste Satellite Accumulation Area," "Oxidizers: Liquids and Solids,"and with the generator name and address(see photo IMG 8539-42). The container also contained several bottles and tubes of hair color and hair developer containing hydrogen peroxide,which are classified as oxidizer hazardous waste according to the Potentially Hazardous Waste Management poster(IMG 8552-5). Christine stated the container is not being emptied daily by the Salon employees, since the container was over half-filled with waste items and the first salon employee for the day would be arriving at Spm on the date of the inspection. -A 4.0 oz aerosol can of Living Proof Perfect Hair Day dry shampoo(IMG 8543-4). -A partially filled 128 fl oz container of Barbicide(IMG 8545-6). However,the scanner identified the waste item as a flammable liquid and solid(IMG 8547). REGULATION GUIDANCE: Incompatible wastes, or incompatible wastes and materials shall not be placed in the same container, unless section 66265.17(b)is complied with. (b)Hazardous waste shall not be placed in an unwashed container that previously held an incompatible waste or material. (c)A container holding a hazardous waste that is incompatible with any waste or other materials transferred or stored nearby in other containers, or open tanks, shall be separated from the other materials or protected from them by means of a dike, berm,wall,or other device. 66265.17(b)Where specifically required by other sections of this chapter,the transfer,treatment, storage,or disposal of ignitable or reactive waste, and the mixture or commingling of incompatible wastes, or incompatible wastes and materials,shall be conducted so that it does not: (1)generate extreme heat or pressure,fire or explosion, or violent reaction; (2)produce uncontrolled toxic mists,fumes,dusts, or gases in sufficient quantities to threaten human health or the environment; (3)produce uncontrolled flammable fumes or gases in sufficient quantities to pose a risk of fire or explosions; (4)damage the structural integrity of the device or facility containing the waste;or (5)through other like means threaten human health or the environment. CORRECTIVE ACTION: Immediately make changes to the hazardous waste storage to eliminate incompatible waste storage. Describe how the waste storage has been changed to correct the violation. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation.
