In accordance with that agreement,the Applicant has agreed to: 1) SJMSCP Incidental Take Minimization Measures and mitigation requirement: 1. Upon issuance of fiilly executed ITMMs and prior to any ground disturbance,the project applicant must: a. Post a bond for paymant of the applicable SJXISCP fee covering the entirely ofthe project acreage being covered(the bond should be valid for no longer than a 6 unonth period);or b. Pay the appropriate SJXISCP fee for the entirely ofthe project acreage being covered;or c. Dedicate land in-lien of fee;,either as comervatirm easements cc fee title..or d. Purcha;eapproved mitigation bank credits- 4. Within 6 month,&am the effective date ofthe ITNIMs or issuance of a building permit,whichever occurs first,the project applicant nnst: a.
