The ER plan submitted to <br />CERS is lacking emergency equipment list (spill kits, absorbent, eye wash stations, fire extinguishers) , ammonia <br />alarm missing in alarm section. Failed to submit a complete Emergency Response and Training Plan by the due <br />date. Submittals on 11/23/20 and 03/16/20 were rejected due to not including the Emergency Response Plan as <br />part of the annual submittal, and it has not been corrected. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: <br />- immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />- procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />- evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br />8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was lacking or insufficient. Training sections missing are; <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br />and submit to the EHD for approval. <br />This is a Class II violation. <br />FA0003837 PR0519885 SC001 04/26/2021 <br />EHD 19-01 Rev. 9/16/2020 Hazardous Materials Program OIRPage 3 of 6 <br />1868 E.
