Environmental Health Department <br />AMENDED <br />4/26/2021 <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 26, 2021 <br />Facility Address: <br />3900 HOLLY DR, TRACY <br />Facility Name: <br />TRACY WASTEWATER TX <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. Failed to submit a complete <br />business plan by the due date. Partial of the business plan (facility information only) was submitted late on 3/16/20 <br />for the 2020 submittal. This submittal was rejected EHD and it was resubmitted on 11/23/20 to include the facility <br />information and Hazardous Materials Inventory. The Emergency Response and <br />Training Plan was not included in this submittal. The 2019 annual submittal was also submitted late on 5/2/19 and <br />5/7/2019. <br />Facility posted a complete Hazardous Material Business Plan on CERS on 4/22/2021. <br />Violation was corrected on site. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />This is a Class II violation. <br />10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, Aloke Vaid stated that Sulfur Dioxide and Chlorine had been removed since <br />Aug 2019. The business has not updated and submitted the change of chemical inventory on the California <br />Environmental Reporting System (CERS) within 30 days of the chemicals removal. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br />- A 100 percent or more increase in the quantity of a previously disclosed material. <br />- Any handling of a previously undisclosed hazardous materials <br />- A change of business address, business ownership, or business name. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br />FA0003837 PR0519885 SC001 04/26/2021 <br />EHD 19-01 Rev. 9/16/2020 Hazardous Materials Program OIRPage 4 of 6 <br />1868 E.
