Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 27, 2021 <br /> Facility Address: <br /> 6649 S TRACY BLVD, TRACY <br /> Facility Name: <br /> TRACY WATER TREATMENT - PRIMARY <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: The training program was not submitted annually as a part of the business plan for years 2019 <br />and 2020. <br />The Continuing Training section within the training program submitted to CERS does not address the following <br />requirements for annual trainings: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br />the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br />States Code. An annual electronic submittal satisfies these requirements. The annual business plan shall be <br />submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the <br />previous year. <br />Training shall includes: <br />A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the <br />current information. Submit statement to EHD stating that the business plan will be submitted to EHD Annually by <br />the due date, January 15. <br />This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The annual HMBP was not <br />submitted for Calendar 2019. The submittal for 2020 included the facility information section only and it was <br />submitted late on 2/25/20.
