Environmental Health Department Hazardous Materials Program Inspection Report Date: April 27, 2021 Facility Address: 6649 S TRACY BLVD, TRACY Facility Name: TRACY WATER TREATMENT - PRIMARY SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # 6 HSC 25505(a)(2) Failed to electronically submit a site map with all required content. OBSERVATION: The site map is incomplete. The current site maps in CERS do not address the location of all the chemicals ( Sodium Hypochlorite, Phosphoric Acid, Oxygen, and Mineral Oi)l. The maps list Sodium Hydroxide. The facility is no longer is using/storing Sodium Hydroxide. The site maps list Aluminum Sulfate as ALUM. The maps do not list the emergency response equipment, and emergency shut offs. The site maps are not numbered, and 2 out of 4 do not contain North Orientation. REGULATION GUIDANCE: A site map shall contain a north orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency response equipment. If a site map element is not applicable for your facility then list it on the map and label as “NA". CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. Any abbreviations and symbols on the site map need to be addressed within the site map. Submit statement to EHD stating that the business plan will be submitted to EHD Annually by the due date, January 15. This is a repeat violation, Class II. 7 HSC 25505(a)(3) Failed to electronically submit an adequate ER procedures for a release or threatened release. OBSERVATION: The Emergency Action Plan (EAP)/Emergency Response and Training Plan was not submitted annually as a part of the business plan for years 2019 and 2020. Dale Klever, David Carter,and Bill Tapia have not been working for this facility for longer than 30 days and the emergency contact and notification list with the EAP has not been updated. The EAP does not list the emergency response equipment at this facility. REGULATION GUIDANCE: The business owner/operator shall annually review and certify that the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United States Code. An annual electronic submittal satisfies these requirements. The annual business plan shall be submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the current and complete information. Submit statement to EHD stating that the business plan will be submitted to EHD Annually by the due date, January 15. This is a Class II violation.
