Mr. Jeffrey D. Wingfield -2- 24 March 2011 <br />In April 2005, the Port completed Preliminary Endangerment Assessments (PEAs) for Sites 07 <br />and IAS-08. The Port submitted the PEAs in place of final closure reports; the PEAs included <br />the information submitted in the draft Closure Reports with additions to address DTSC and <br />Central Valley Water Board staff comments. At that point in time, the sites were ready for <br />formal public review. On 15 December 2008 the Port published a Public Notice in the <br />Stockton Record newspaper for closure of sites including Sites 07 and IAS-08. Public <br />comments were to be sent to DTSC between 18 December 2008 and 17 January 2009. <br />On 26 January 2009 DTSC issued a letter documenting the conclusion of the public <br />comment period, indicating that no public comments were received, and stating that final <br />agency approval of closure could be provided as soon as the Port finalized the PEAs. On <br />23 March 2009 the Port submitted a final PEA Site IAS-08. Although the Port's cover letter <br />indicated that the PEA for Site 07 was enclosed, it was not. A final PEA for an unrelated site <br />(Site 08) was enclosed instead. <br />Staff Comments <br />The Port should submit a final PEA for IR Site 07. Slip pages that can be used to update the <br />April 2005 PEA are adequate. In addition, the Port should upload the final PEA for Site 07 to <br />GeoTracker. <br />The proposal to destroy the monitoring wells and piezometers is acceptable to Central Valley <br />Water Board staff. However, staff approval will be granted after the Port resubmits the Work <br />Plan, signed by a qualified professional engineer or geologist.
