A Description of the Physical and Economic <br />Conditions Existing in the Project Area <br />Legal Definitions and Standards <br />Chapter 4.5 (Sections 33492 through 33492.29) of the Law was enacted to <br />provide a means of mitigating the economic and social degradation that is <br />faced by the communities when military bases have been ordered to be <br />closed by federal action. Sections 33492.10 and 33492.11 of the Law provide <br />specific definitions of a "blighted area" for project areas that are closed <br />military bases. <br />Section 33492.10 of the Law states that a blighting area within the <br />boundaries of the military base is an area in which the combination of two or <br />more conditions set forth in Section 33492.11 is so prevalent and substantial <br />that it causes a reduction of or lack of proper utilization of the area to an <br />extent that constitutes serious physical and economic burden on the <br />community which cannot reasonably be expected to be reversed or alleviated <br />by private enterprise or governmental action, or both, without redevelopment. <br />Pursuant to Section 33492.11 of the Law, conditions that cause blight <br />include: <br />Buildings in which it is unsafe or healthy for persons to live or work. <br />These conditions can be caused by serious building code violations, <br />dilapidation and deterioration, defective design or physical construction, <br />faulty or inadequate infrastructure or other similar factors. <br />Factors that prevent or substantially hinder the economically viable reuse <br />or capacity of buildings or areas. This condition can be caused by <br />conditions including, but not limited to, all of the following: a substandard <br />design; buildings that are too large or too small, given present standards <br />and market conditions; age, obsolescence, deterioration, dilapidation, or <br />other physical conditions, that could prevent the highest and best uses of <br />the property. Buildings that will have to be demolished, or buildings or <br />areas that have a lack of adequate parking can also cause this condition. <br />Adjacent or nearby uses that are incompatible with each other and that <br />prevent the economic development of those parcels or other portions of <br />the project area. <br />ROSENOW SPEVACEK GROUP, INC.
