The Porter-Cologne Water Quality Control <br />Act gives the Board broad authority to require monitoring and technical <br />reports at sites where water quality may be affected. You state that <br />these wells were installed in 1991 to "establish baseline conditions and <br />fulfill property due diligence." I surmise from this that MSC purchased <br />the property at that time. MSC then proceeded to conduct industrial <br />activities at the site, which I surmise have now ceased. It is <br />reasonable to think that these activities could have affected water <br />quality, and since you have baseline sample results from before MSC <br />began operating, current samples would show if there was any water <br />quality degradation that could be attributed to those activities. Thus, <br />MSC would not be "vacuumed into a clean up order for activities and <br />ground water issues that would be unrelated to its activities." <br />> <br />I look forward to receiving the baseline sampling report from 1991. I <br />suggest you also prepare a simple letter work plan for the upcoming <br />sampling to state what consituents will be analyzed and by what <br />analytical methods before conducting the sampling. <br />> <br />Let me know if I can be of further assistance. <br />1
