By way of background, as you know, and per our discussions, <br />Metropolitan Stevedore Company (MSC) would like to destroy and properly <br />close four monitoring wells at a portion of its current leased facility <br />leased from the Port of Stockton. MSC constructed the subject wells in <br />1991 in order to establish baseline conditions and fulfill property due <br />diligence. MSC's monitoring wells have not been subject to any <br />regulatory clean up orders and or monitoring obligations. <br />The site similar to the majority of the Port's land parcels have <br />been used for industrial use in the past and there were and are <br />industrial activities nearby. <br />My firm, TRE Consulting has been hired by MSC to work with the San <br />Joaquin County EHD to properly close these wells so they do not become a <br />conduit for ground water contamination. In working with Mike Infurna <br />and Margaret Lagorio of the San Joaquin County EHD, sampling and <br />analysis of representative ground water samples have been identified as <br />a requirement which according to the County EHD has been mandated by <br />your office. We are working very diligently with MSC in partnering with <br />the SJ County EHD toward accomplishing 4 primary tasks toward the <br />closure of the wells under the SJ County Ordinance Code, Chapter 9-1115. <br />1. Submit a Master file application and a check for the amount of $267 <br />2. Asses the monitoring wells conditions <br />3. Coordinate a field appointment with your office for sampling of <br />these wells <br />4. Submit a report of the findings of the sampling and analysis to you <br />and Wendy Cohen of the CVRWQCB. <br />Given the above background and framework, on behalf of MSC, we <br />would, however, ask for clarification as to the CVRWQCB's regulatory <br />authority which requires MSC to sample these wells. Also, given the <br />industrial surroundings of the site and its industrial history, MSC's <br />primary concern is not to be vacuumed into a clean up order for <br />activities and ground water issues that would be unrelated to its <br />activities. <br />In any event, we are working very closely with Mike Infurna of the <br />County EHD toward the physical closure of these wells. Relative to any <br />potential ground water issues, we would like to meet with you and your <br />staff to hold a meeting discuss the foregoing issues.
