Complaint Investigation Summary <br /> Report #. 5105 <br />COMPLAINT ID: COELYLTNF Site Location: Lone tree Rd. 1,200 feet east of Wagner Rd. <br />Activity Summary <br />Activity Date Recorded by <br />08/10/2018 Cesar Ruvalcaba with EHD asked me to follow up on the cleanup of this incident. SAEED <br />The cleanup has not been scheduled. At 9:25am I called Alex Steele and Dave <br />Larsen with PG&E and they did not answer. I left a voicemail for Alex to let me <br />know when they will conduct the cleanup. At 10:07am since I have not heard from <br />either one, I called again, and they did not answer. At 10:09am Dave called me <br />back, and told me he is sick and will not start the cleanup until Monday morning ( <br />08/13/18 around 09:00am). Sample was taken. Roll bin already on site. I called <br />Cesar and email him to update him on this delay. <br />08/13/2018 Received complaint information from Cesar R. Text Dave Larsen from the ER cell FLORIDO <br />phone telling him to let me know when he will be done with the clean-up today so <br />that I may verify prior to backfill. <br />Called Dave Larsen at noon to get an update on the clean-up. Dave said he was <br />just about to arrive to the site to begin cleaning. Dave stated he will let me know <br />when I should leave the office to the site to verify the clean-up. <br />Received a call from Dave Larsen at 2:52 pm that I should head to the site. <br />Arrived on site with Kashif Ali and witnessed a large area of soil excavated <br />adjacent the pole transformer on the south side of Lone Tree Rd. about 1/2 mile <br />east of Wagner Rd. Dave had excavated enough soil to fill one roll-off bin. A small <br />area of soil still had some oil staining. Dave continued excavated until there was <br />no more oil staining in the area. The excavation of the mineral oil spill is complete. <br />According to Dave, a sample from the transformer oil was taken for analysis. <br />White stains from the spilled milk were also observed in the soil along the <br />shoulder of Lone Tree Rd. The milk staining ran about 50 ft. west of the <br />excavation. Left site. <br />08/16/2018 Drove to site to witness cleanup. Two to three inches of topsoil was removed from RUVALCABA <br />the affected area. No evidence of remaining milk was observed. The removed soil <br />was placed in a trailer to be hauled to a designated dump. Arrangements had <br />been previously made, per Frank Amara, owner of Superior Truck Lines. <br />JoAnn Oliveira was onsite. JoAnn is with Winton-Ireland, Strom & Green <br />Insurance Agency. Called responsible <br />party and obtained billing address <br />07/11/2019 Per accounting's request called the responsible party since the bill has been <br />unpaid. Called Tom Lindsey, owner of Titan Fence. His brother Sidney Lindsey <br />was operating the vehicle that according to the CHP report, caused the accident. <br />Tom stated that he has been receiving the bills and that he has been forwarding <br />them to his insurance company. Tom stated that he would give me the contact <br />information for the insurance company. Tom believed that his brother was not <br />responsible for the accident. It was pointed out that the department does not make <br />the determination and that the CHP accident report clearly lists Sidney Lindsey as <br />the cause of the accident. Tom stated that the insurance company is fighting that <br />claim. Tom was reminded that the EHD is not involved in those matters and that <br />the insurance companies would have to figure that out. If the insurance company <br />came to a different conclusion then they would figure who pays what. In the <br />meantime the billing will continue. <br />RUVALCABA <br />5105 rpt <br />Page 2 of 2
