Box 1810 <br /> Stockton, California 95201 <br /> Subject: Review of Final Closure and Postclosure Maintenance <br /> Plans, Harney Lane Sanitary Landfill, San Joaquin <br /> County, Facility No. 39-AA-0003 <br /> Dear Mr. Horton: <br /> This letter is in response to the Final Closure and Postclosure <br /> Maintenance Plan - Harney Lane Sanitary Landfill, California, <br /> dated Revised for Resubmittal January 1992 . <br /> Public Resources Code sections 40000 et seq. establish the <br /> California Integrated Waste Management Board (Board) as the <br /> entity responsible for the oversight of waste management <br /> practices throughout the State of California. The Board has <br /> independent authority to regulate and impose requirements on <br /> solid waste facility operators. Compliance with the requirements <br /> of another regulatory agency does not satisfy an operator's legal <br /> duty to comply with regulatory requirements promulgated by this <br /> Board. Operators issued solid waste facility permits by this <br /> Board must comply with all permit terms and conditions and <br /> standards adopted by the Board. <br /> Public Resources Code 43509 required the Board, as an independent <br /> entity, to adopt regulations specifying closure plan and <br /> postclosure maintenance plan (Plans) adoption procedures and <br /> uniform closure and postclosure maintenance ,standards. Operators <br /> must comply with the procedures and standards adopted by this <br /> Board for these purposes. compliance with another agency's <br /> requirements may not satisfy the concerns of this Board in <br /> relation to closure and postclosure maintenance. All information <br /> required by or submitted to the Central Valley Regional Water <br /> Quality Control Board (Regional Water Board) , and Local <br /> Enforcement Agency (LEA) , or the Board as revisions and additions <br /> to the Plans must be submitted to the other agencies. <br /> Board staff is somewhat concerned with how the Plans address <br /> specific areas of compliance. Title 14, California Code of <br /> Regulations (14 CCR) , Division 7, Chapter 3 , Article 7 .8 lists <br /> numerous specific areas of landfill closure and postclosure <br /> maintenance activities which need to be individually addressed. <br /> Apparently portions of the Harney Lane Landfill Closure Plans, <br /> such as section 14 . 0 (Installation of Groundwater Monitoring <br /> --Printed on vc)-iod Paper-- <br />
