Mr. Tom Horton
Page 2
• A monitoring plan for the control measures initiated along
with a health risk assessment to insure that LDG
constituents are not leaving the landfill boundary in
concentrations which might pose a significant health risk at
or beyond the landfill boundary.
If you choose not to undertake the above action, the Board may
ask the Local Enforcement Agency (LEA) to issue a Corrective
Action Order or the Corrective Action Order may be issued by the
Executive Director of the Board. The Corrective Action Order
will set forth the required action and time frame. Failure to
respond to or comply with the order may result in the Board
contracting for the corrective action.
If the Board expends our own funds, the owner and operator of the
solid waste facility will be obligated to reimburse the Board an
amount equal to the amount expended, a reasonable amount for the
Board's cost of contract administration, and an amount equal to
the interest that would have been earned on the expended funds.
Please submit a workplan to Bob Fujii, acting Manager of the
Closure and Remediation Branch, and Ed Padilla, Senior
Environmental Health Specialist, by July 15, 1992. Board Staff
and LEA Staff are more than willing to work with your staff to
correct these problems. If you have any questions, or wish to
discuss this letter, feel free to call me at (916) 255-2491 or
Tim Crist at (916) 255-2498.
Respectfully,
Bob Fujii
Acting Branch Manager
Permitting and Compliance Division
TWC:
CA039\CALETR\Harney.39
