COMPASS LAND <br /> G R O U P <br /> 3. §9-605.6(m)(1)(C): The continuation of the accessory use does not preclude replacement <br /> and modification from time to time of obsolete, inefficient, and/or nonfunctional <br /> equipment and modernization, including, but not limited to, an increase in hourly <br /> production, provided the annual production is not increased. <br /> Consistency Determination: Consistent. GRI maintains the plant equipment, as needed, <br /> to ensure safe and efficient operation and maintain compliance with applicable <br /> regulatory requirements (e.g., San Joaquin Valley Air Pollution Control District, Central <br /> Valley Regional Water Quality Control Board). No changes to approved production levels <br /> are requested. <br /> 4. §9-605.6(m)(1)(D): Reclamation of the excavation site subject to the Quarry Excavation <br /> Permit, less the area occupied by the accessory use,shall be completed or shall be initiated <br /> prior to or simultaneously with the approval of the application for Revision of Approved <br /> Actions and shall be completed within two (2) years of the commencement of the <br /> reclamation process. <br /> Consistency Determination: Consistent. The former excavation area located outside of <br /> the accessory use area has been reclaimed consistent with the approved Reclamation <br /> Plan. As described in the response to §9-605.6(m)(1)(E), below,the area occupied by the <br /> accessory use will be reclaimed within the term specified by the permit, unless otherwise <br /> extended. <br /> 5. §9-605.6(m)(1)(E): The area occupied by the accessory use shall be reclaimed within the <br /> time permit required by the Revision of Approved Actions, and if there is no such time <br /> period requirement in the Revision of Approved Actions, the reclamation process shall be <br /> completed within two (2) years of the expiration of the Revision of Approved Actions or <br /> within two (2) years of the time that the accessory use ceases to be operated or utilized, <br /> whichever comes first. <br /> Consistency Determination: Consistent. Requirement acknowledged. The area occupied <br /> by the accessory use will be reclaimed within the term specified by the permit, unless <br /> otherwise extended. <br /> 6. §9-605.6(m)(1)(F): The term of the Revision of Approved Actions allowing continuation of <br /> the accessory use shall be determined by an amortization schedule based upon the <br /> projected useful life of the accessory use. The term of the Revision of Approved Actions <br /> shall not exceed thirty (30) years from the date the Revision of Approved Actions is <br /> approved. <br /> Page 5 <br />
