Financial Responsibility <br /> The applicant has demonstrated by means of a financial <br /> statement the availability of financial resources to <br /> properly plug and abandon the well. If issued a permit, <br /> the applicant will be required to send updated information <br /> to the Regional Administrator within 90 days after the <br /> close of each succeeding fiscal year. <br /> g. Corrective Action <br /> According to 40 CFR §144.55(a) , corrective action is <br /> defined as a plan consisting of such steps or modifications <br /> as are necessary to prevent movement of fluid into under- <br /> ground sources of drinking water through wells which are <br /> improperly sealed, completed, or abandoned within the area <br /> of review. Only two oil and gas exploratory wells <br /> penetrate the proposed injection zone. within the area of <br /> review (3 mile radius from the proposed well) . Both of <br /> these wells are properly plugged according to California <br /> Division of Oil and Gas reports. Therefore, no corrective <br /> action is required. <br /> h. Plugging and Abandonment <br /> The draft permit requires the permittee to notify the <br /> Director no later than 45 days before conversion or aban- <br /> donment of the well. The permittee is required to plug and <br /> abandon the well in the manner prescribed in the plugging <br /> and abandonment plans. The plugging and abandonment plans <br /> are incorporated as a part of the draft permit and are con- <br /> sistent with 40 CFR §146. 10. Within 60 days after plugging <br /> the well, or at the time of the next quarterly report <br /> (whichever is shorter) , the permittee shall submit a report <br /> to the Director. The report shall be certified by the per- <br /> son who performed the plugging operation, and shall consist <br /> of either: <br /> (1) a statement that the well was plugged in accordance <br /> with the plan previously submitted to the Director; or <br /> (2) if the actual plugging differed from the approved plan, <br /> a statement describing the actual plugging procedure <br /> and reasons why the Director should approve such a <br /> deviation. Any deviation from a previously approved <br /> plan may be cause for the Director to require the <br /> operator to replug the well. <br /> 10 <br />
