Testing has not been <br /> completed and is thirteen months past due. <br /> REGULATION GUIDANCE:All spill containers shall have a minimum capacity of five gallons, be capable of <br /> containing a spill or overfill until it is detected or cleaned up and testing is required once every 12 months. <br /> CORRECTIVE ACTION: <br /> -Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a <br /> properly licensed,trained, and certified contractor under permit and inspection of the EHD. If the spill container <br /> can't be replaced immediately,there is a possibility that the 3000 gallon 91 UST system may be red tagged to <br /> prevent fuel inputs. <br /> -Immediately schedule this test and provide 48 hours notification to the EHD. Please be aware that all EHD staff <br /> time associated with a reinspection will be billed at our current hourly rate. <br /> This is a Class II violation. <br /> 319 CCR 2635, 2637.2,2665, 2712 Failure to comply with overfill prevention equipment requirements. <br /> OBSERVATION: <br /> -Overfill prevention testing was conducted on 5/26/2021. <br /> -Overfill prevention testing has not been conducted on the 3000 gallon 91 tank <br /> REGULATION GUIDANCE: Overfill prevention equipment inspections were required to be conducted by October <br /> 13, 2018, and every 36 months thereafter, and within 30 days of completion of a repair. <br /> CORRECTIVE ACTION: Immediately schedule this testing and provide 48 hours notification to the EHD. Ensure all <br /> future testing is conducted within required time frames. <br /> This is a repeat violation, Class 11. <br /> 320 CCR 2635(c)(1)Overfill prevention was overridden. <br /> OBSERVATION: The mechanical overfill prevention device on the diesel UST is currently overridden by the <br /> presence of a measuring stick placed in the drop tube. <br /> REGULATION GUIDANCE:All underground storage tanks shall be equipped with an overfill prevention device that <br /> does not allow for manual override and either shuts off or restricts flow into the tank. <br /> CORRECTIVE ACTION: The stick was removed by the service technician on site.
