ENTRY AGREEMENT FOR ENVIRONMENTAL <br /> INVESTIGATION AND REMEDIATION ACTIVITIES <br /> This ENTRY AGREEMENT FOR ENVIRONMENTAL INVESTIGATION AND <br /> REMEDIATION ACTIVITIES between Pacific Gas and Electric Company(PG&E) and <br /> Donald L.Zeller and Carrolle J. Zeller(hereafter referred to as "Owners") effective <br /> 2003, is in regard to Owners'property more particularly described in <br /> the deed recorded as Instrument Number 94107012, San Joaquin County records <br /> (Owners'Property), and located adjacent to the lot commonly known as PG&E's Lathrop <br /> Dehydrator Station(the Station). <br /> Owner and PG&E understand that: <br /> A. PG&E has conducted extensive environmental investigations at its <br /> Lathrop Dehydrator Station and on Owners'Property adjacent to the <br /> Station to determine the horizontal and vertical extent of petroleum <br /> hydrocarbons in the soil and groundwater resulting from PG&E Station <br /> operations; <br /> B. PG&E desires to continue its investigation and to perform environmental <br /> remediation activities on Owners' Property and PG&E's Station to reduce <br /> the concentrations of petroleum compounds in the soil and/or the <br /> groundwater; <br /> C. Owners desires to have PG&E continue to enter its property to perform its <br /> investigation activities and to undertake environmental remediation <br /> activities, all in accordance with plans approved by the Central Valley <br /> Regional Water Quality Control Board(CVRWQCB); and, <br /> D. Environmental clean-up activities are invasive, require heavy equipment <br /> to remove soil and/or groundwater,and may take several days, or longer, <br /> to complete. <br /> Therefore,PG&E and Owners agree as follows: <br /> 1) Owners grant to PG&E, including its employees, contractors, subcontractors and <br /> agents, a temporary license to enter Owners' Property, to conduct environmental <br /> investigation and remedial activities necessary to periodically monitor and remove as <br /> reasonable, petroleum compounds in the soil and/or the groundwater related to <br /> PG&E's operations at its Lathrop Dehydrator Station (PG&E's Activities). PG&E's <br /> Activities may include (but are not limited to) sampling, maintenance and removal of <br /> groundwater monitoring wells, extraction of soil borings, excavation of soil to the <br /> approximate depth of groundwater, dewatering of any excavation areas, and backfill <br /> and reseeding of excavated areas. <br /> 2) The term of this license agreement shall be five years, and it shall terminate five years <br /> from the Effective Date, or upon removal by PG&E of all groundwater monitoring <br /> wells on Owners' property,whichever occurs earlier.
