Entry Agreement for Environmental Investigation and Remedial Activities <br /> Page 2 of 3 <br /> 3) Owners shall be compensated$2,000.00(two thousand dollars)per year for each year <br /> or portion of a year in which groundwater monitoring wells remain on Owners' <br /> Property pursuant to this Agreement. Should PG&E's remedial activities interfere <br /> with Owners' ability to grow and/or harvest crops on Owners' Property adjacent to <br /> PG&E's station,then PG&E shall compensate Owners a one-time amount of <br /> $5,000.00 (five thousand dollars)for Owners' inconvenience and lost profit. <br /> 4) PG&E shall notify Owners at least forty-eight hours in advance of entering Owners' <br /> Property to perform groundwater monitoring activities. PG&E's remedial Activities <br /> shall be performed at a time mutually agreed by both Owners and PG&E. <br /> 5) PG&E shall close the monitoring wells it installed on Owners' Property in accordance <br /> with all local, State and Federal regulations,when the CVRWQCB grants permission <br /> to do so. PG&E shall submit to Owners copies of any reports on well closure that are <br /> submitted to the CVRWQCB or any other regulatory agency having jurisdiction over <br /> the monitoring wells on Owners' Property. <br /> 6) PG&E's Activities on Owners' Property will be in accordance with plans approved <br /> by the CVRWQCB. Copies of the approved plans shall be given to Owners prior to <br /> the inception of remedial activities on Owners' Property. The amount of soil <br /> excavated will be determined by the CVRWQCB in accordance with its policies and <br /> regulations. Excavation shall occur approximately in the area outlined in Figure A. <br /> 7) PG&E's Activities may occur between 6:00 AM and 6:00 PM, seven days per week. <br /> PG&E will restrict access to the area where remedial activities occur, and will store <br /> and stage necessary remedial equipment,vehicles and other materials overnight and <br /> over weekends in the restricted area. The approximate area to be restricted by the use <br /> of temporary fencing during remedial activities is outlined in Figure A. <br /> 8) While PG&E's remedial activities are ongoing,PG&E and Owners shall use best <br /> efforts to co-operate and minimize interference with each other's activities in the <br /> vicinity of the PG&E Station. <br /> 9) PG&E will backfill any excavation area on Owners' Property to it as near as possible <br /> to its original grade. Excavation depths below the groundwater table will be filled <br /> with gravel, and fill material approved by Owners will be used above the ground <br /> water table. Any roads that are excavated will be replaced with equivalent or better <br /> construction materials, and any ditches that are excavated will be restored as ditches <br /> using equivalent or better construction materials. <br /> 10)Excavated soil from Owners' Property will be removed and disposed-of by PG&E in <br /> accordance with all federal, state and local regulations,or be re-used by PG&E as <br /> excavation fill,whenever possible and appropriate. <br /> 11)After backfilling is complete, PG&E and Owners shall mutually agree on a reseeding <br /> mixture to be used on backfilled areas. <br /> E 'd GOG9- iE9-SZ6 0044aawS eB0 =0T EO 90 2nd <br />
