During that conversation with Ms. Devra Lewis of my <br />staff, you stated that you are not financially able to perform the work proposed in the <br />4 August 2004 Workplan Groundwater Monitoring and Soil Assessment/Delineation or the <br />investigation report requested in the Regional Board staffs 15 September 2004 letter regarding <br />the foinier Schmiedt Soil Service Incorporated property at 20696 South Main Street in Manteca <br />(site). <br />As further discussed during the phone conversation, we are sending this letter requesting <br />information needed to demonstrate financial hardship. State Water Resources Control Board <br />Resolution No. 92-49 Policies and Procedures for Investigation and Cleanup and Abatement <br />Under Section 13304 of the Water Code states, "Availability of financial resources should be <br />considered in establishment of reasonable compliance schedules." Therefore, you may receive <br />additional time to perform the work proposed and submit the requested investigation report. <br />However financial hardship does not eliminate the responsibility for investigation of pollution at <br />the site. <br />If additional time is needed due to financial hardship, you need to submit the following <br />information by 22 April 2005: <br />Federal tax returns for the last two years; <br />Balance sheets, and profit and loss statements for Schmiedt Soil Service Incorporated two <br />most recent years of operation; <br />A schedule detailing all real property interests and liabilities associated with those <br />interests; <br />Information regarding all other business interests; <br />California Environmental Protection Agency <br />%,;$ Recycled Paper
