SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR-Notice to Comply) A complaint was received on June 20, 2012 which alleged that the tenant of the property is generating and storing hazardous waste. Inspections were conducted on June 28, 2012, August 1, 2012 and August 31, 2012. The complaint was found to be valid and a notice to abate was issued to the business owner. A corrective actions statement and supporting documentation was received on July 18, 2012 by our department. However the corrective actions statement and supporting documentation were not adequate and a second notice to abate was issued outlining the missing items. On August 31, 2012 a final inspection was conducted but no one was at the property at that time. A violation checklist was issued to the business operator on September 4, 2012 for the final inspection. The following is a summary of violations that were noted on the checklist: 101. This facility's EPA ID number was inactive. A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without an active EPA ID number. A temporary EPA ID number (CA0002681515) was issued and is only valid for 90 days. On 6/29/12 this temporary EPA ID number was found to be inactive. Hazardous waste was transported and disposed of without an active EPA ID number. On 08/13/12 another temporary EPA ID number (CAC002701882) was issued. 108. Several containers are still located on the property some of which are storing unknown contents — (24) 295 gal. totes. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately make a hazardous waste determination for the contents of the containers and manage it according the Title 22 hazardous waste regulations. Continued on page 5.
