FA_ <br />E <br />BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br />STATE OF CALIFORNIA <br />R-89-_� <br />RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF STIPULATIONS FOR <br />THE SOLID WASTE CLOSURE ENTERPRISE FUND, AND FOR THE ADDITION <br />OF THE NORTH COUNTY SANITARY LANDFILL SUB -BUDGET UNIT TO THE <br />SOLID WASTE CLOSURE ENTERPRISE FUND <br />WHEREAS, Assembly Bill 2448 mandates landfill operators to <br />establish a trust fund or equivalent acceptable financial <br />mechanism to ensure adequate resources for closure and post - <br />closure maintenance activities for landfills in California; and <br />WHEREAS, on December 6, 1988, the County of San Joaquin <br />Board of Supervisors, to comply with Assembly Bill 2448, passed <br />and adopted Resolution R-88-1323 which provided for the <br />establishment of the Solid Waste Closure Enterprise Fund (SWCEF); <br />and <br />WHEREAS, the purpose of the SWCEF is to dedicate its revenue <br />exclusively to financing closure and/or postclosure maintenance <br />of the Harney Lane and Foothill Sanitary Landfills; and <br />WHEREAS, the County of San Joaquin is currently in the <br />process of developing and permitting the North County Sanitary <br />Landfill, and must comply with Assembly Bill 2448 by establishing <br />a closure and postclosure maintenance fund for the landfill; and <br />WHEREAS, the California Waste Management Board (CWMB) has <br />adopted new regulations which impact the County's SWCEF; and <br />WHEREAS, the County of San Joaquin is required to comply <br />with the new regulations adopted by the CWMB, and it is desirable <br />to have all requirements set out in a single Resolution <br />containing both the provisions of Resolution R-88-1323 and the <br />provisions required by the new regulations. <br />NOW, THEREFORE, BE IT RESOLVED that this Board of <br />Supervisors hereby reaffirms the creation of the SWCEF, in <br />accordance with Government Code Section 25261, and effective <br />December 6, 1988. <br />
