FA_ E BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN STATE OF CALIFORNIA R-89-_� RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF STIPULATIONS FOR THE SOLID WASTE CLOSURE ENTERPRISE FUND, AND FOR THE ADDITION OF THE NORTH COUNTY SANITARY LANDFILL SUB -BUDGET UNIT TO THE SOLID WASTE CLOSURE ENTERPRISE FUND WHEREAS, Assembly Bill 2448 mandates landfill operators to establish a trust fund or equivalent acceptable financial mechanism to ensure adequate resources for closure and post - closure maintenance activities for landfills in California; and WHEREAS, on December 6, 1988, the County of San Joaquin Board of Supervisors, to comply with Assembly Bill 2448, passed and adopted Resolution R-88-1323 which provided for the establishment of the Solid Waste Closure Enterprise Fund (SWCEF); and WHEREAS, the purpose of the SWCEF is to dedicate its revenue exclusively to financing closure and/or postclosure maintenance of the Harney Lane and Foothill Sanitary Landfills; and WHEREAS, the County of San Joaquin is currently in the process of developing and permitting the North County Sanitary Landfill, and must comply with Assembly Bill 2448 by establishing a closure and postclosure maintenance fund for the landfill; and WHEREAS, the California Waste Management Board (CWMB) has adopted new regulations which impact the County's SWCEF; and WHEREAS, the County of San Joaquin is required to comply with the new regulations adopted by the CWMB, and it is desirable to have all requirements set out in a single Resolution containing both the provisions of Resolution R-88-1323 and the provisions required by the new regulations. NOW, THEREFORE, BE IT RESOLVED that this Board of Supervisors hereby reaffirms the creation of the SWCEF, in accordance with Government Code Section 25261, and effective December 6, 1988.
