SAN JOAOUIN <br />Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Facility Name: Facility Address: Date: <br />BURGER KING #10834 4608 E WATERLOO, STOCKTON June 16, 2021 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />8 <br />HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: Blank safety meeting sign -in sheets were uploaded in a zip file in lieu of an employee training plan. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />7atened <br />Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br />and submit to the EHD for approval. <br />This is a repeat violation, Class II. <br />9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15, for 2018, 2019, and 2020. The <br />business plan submittal was not completed until 6/11/18 for 2018; only the facility information was submitted during <br />2019; the business plan submittal for 2020 was not completed until 2/11/20. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This was corrected on site. <br />This is a repeat violation, Class II, <br />1 P00520715 crnni naiianml <br />FA000763 <br />EHD 19-01 Rev. 9/16/2020 Page 3 of 4 Hazardous Materials Program OIR <br />1868 E.
