SANTA FE ROAD, RIVERBANK, SAN <br />JOAQUIN COUNTY, LUST CASE #392008 <br />On 6 .November 2019 Condor Earth Technologies (Condor) submitted their Evaluation <br />for Low Threat Case Closure (Closure Evaluation) on your behalf for the Former Ranch <br />Market underground storage tank petroleum release case at 23569 S. Santa Fe Road in <br />Stockton (Site). In the Closure Evaluation, Condor recommended closure of this case. <br />In a 7 January 2020 letter, Central Valley Regional Water Quality Control Board (Central <br />Valley Water Board) staff concurred with closure, and requested completion of a 60 -day <br />public comment period. In April 2020 Condor distributed a Public Notice Fact Sheet to <br />property owners/tenants of surrounding properties, inviting public comment during a <br />comment period between 10 April and 14 June 2020 (65 days). <br />One comment was received during the public comment period via email on 27 May <br />2020 (attached with this letter). This comment was received from Mr. Jose Cano, owner <br />of the 23659 S. Santa Fe Road property, two parcels to the south of the Site, and <br />location of the active Barrera's Market UST petroleum release case, for which Mr. Cano <br />is the Responsible Party. Mr. Cano's comments indicate the following: <br />• He wishes to secure State funding for his Barrera's Market UST case before the <br />Ranch Market case is closed. <br />• He wants to be able to use Ranch Market monitoring well MW -7 as part of his <br />investigation but does not want to be liable for the destruction of this well if he <br />does not receive State funding. <br />• He does not want to be liable for cleanup of the Barrera's Market property if <br />contamination on this property can be linked to the Ranch Market case. <br />In response, Central Valley Water Board staff has the following comments: <br />1. In order to adequately address Mr. Cano's comments, Central Valley Water <br />Board will defer final concurrence on the Ranch Market case closure until after <br />initial investigation at the Barrera's market property. <br />KARL E.
