53. Sound walls, meeting the design requirements contained in the MHCSD Design Guidelines, shall be <br /> installed on arterial streets (except for Central Parkway) and collector streets when the adjacent <br /> development (or phased development) has lots backing onto the street. The length of the sound wall <br /> shall match the total length of the lots backing onto the street plus an additional length that will close <br /> a gap to a previously constructed wall not more than 200 feet away or to the end of the first block. <br /> 54. The sound walls shall be constructed consistent with the MHCSD Design Manual,the Master Plan and <br /> as shown on the preliminary sound wall plans. The noise barrier may consist of a wall, berm, or <br /> combination thereof,the exact location, height and character of the sound barrier shall be determined <br /> by a noise consultant approved by the County and the MHCSD. The sound study shall comply with <br /> the Neighborhood K & L Initial Study Sound Study. <br /> 55. Except when the MHCSD General Manager specifies otherwise, when a sound wall is installed on an <br /> arterial street, the adjacent street edge landscaping, sidewalk, and street curb & gutter shall also be <br /> installed. <br /> 56. Construction Traffic shall comply with the Construction Truck Management Plan administered by the <br /> MHCSD. Project construction plans shall include specifications to the contractor outlining compliance <br /> requirements. <br /> 57. To control erosion and sedimentation during project construction and operation, the developer shall <br /> comply with MHSWMP policies, MHSWMP mitigation measures, and Phase I and II NPDES permit <br /> requirements, including the preparation and implementation of a SWPPP that outlines BMPs to be <br /> followed to minimize erosion and sedimentation during project construction and operation. The <br /> Developer shall have qualified NPDES personnel on site.The developer shall pay all cost associated <br /> with the implementation and inspection of these requirements. <br /> 58. The developer shall build the required drainage system and water quality basins as required by <br /> MHCSD to accommodate runoff from the project. <br /> 59. Water Quality Basins Mosquito Abatement: Plans for the implementation and maintenance of the <br /> water quality basins and any other storm drainage facilities involving open bodiesof water shall be <br /> reviewed and approved by the MHCSD and if required by the Mosquito Abatement District. <br /> 60. All non-residential (Le. Office, Industrial, Commercial, etc), uses must enter into an NPDES storm <br /> water agreement with MHCSD. <br /> 61. UTILITIES <br /> A. The Developers and contractors shall comply with Ordinance No. 4162"Street Opening and <br /> Pavement Restoration Regulations". <br /> B. When any portion of an arterial street is to be included in a development's construction plans, <br /> then all of the buried utilities that are ultimately planned to be within the improvement area <br /> shall be installed as part of the street improvement project, regardless of any of the utilities <br /> needed for any phase of the development associated with the street construction. Conduits <br /> or sleeves may be installed in lieu of the buried utility, if approved by the MHCSD Public <br /> Works Director. <br /> C. Any phased development shall install all"in-tract" utilities needed to serve its development. In <br /> addition, if any future adjacent or nearby phases of the development, or adjacent <br /> Neighborhoods, will depend on obtaining service from such utilities, then the utility lines shall <br /> be sized to serve these future developments. Any utility lines that are intended to be used by <br /> an adjacent development or Neighborhood shall be installed up to the phase or Tentative Map <br /> boundary line to make it available for future extension. To recoup all or a portion of any over <br /> sizing costs, the developer may request the MHCSD to process a reimbursement agreement <br /> PA-1000267—Conditions of Approval 14 <br />
