Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: C00051676 Site Location: 5100 HVVY 12 <br />Activity Summary <br />Activity Date <br />02/25/2020 Cont'd from day. <br />5:00 PM Met with Tony Alegre, owner of Frank C. Alegre Trucking, and his son <br />Andress Alegre. Tony Alegre granted access to the property for complaint <br />investigation, however, he did not consent to photos or samples. Tony, Andress, <br />and I went to the spill area in the back of the lot. I observed brownish oily liquid <br />standing and not actively flowing over approximately 100 feet of the concrete <br />gutter that leads to the storm drain. There was visible dark oily staining at the <br />storm drain. Tony, Andress, and I then walked to the retention pond which is about <br />100 feet West of the storm drain and spill area. I did not observe any oily staining <br />or dark oily liquid exiting or surrounding the retention pond's inlet. The ballast <br />beneath the inlet did not have an oily sheen. During the inspection, Tony Alegre <br />changed his mind and allowed me to take one sample of the brownish oily liquid <br />from the concrete gutter and to take a picture of the sample. After leaving the <br />retention pond, we went back to the spill area. Henry Rotor, Frank C. Alegre's <br />Safety Director was at spill area and had already applied absorbent pads and <br />absorbent over the brownish oily liquid area. He left one section about 20 feet east <br />of the storm drain without an absorbent pad for the purpose of sampling. I <br />collected a sample of the brownish oily liquid from the spill area previously set <br />aside without an absorbent pad. Using a scoop, I poured the brownish oily liquid <br />into a 16 oz glass jar. I labeled the jar to document my name, date, time, the <br />location of sample. I took photos, placed the sample in an ice chest with ice, and <br />completed the chain of custody. Henry Rotor then applied absorbent over the <br />remaining brownish oily liquid spill area. I completed a Notice to Abate and <br />emailed to Henry Rotor at: Henry@alegretrucking.com per Tony Alegre's request. <br />The site condition when I left was: the brownish oily liquid was still covered with <br />absorbent pad and absorbent pads. <br />7:18 END <br />02/25/2020 4:18 PM Left EHD for complaint investigation. <br />4:44 PM Arrived at destination. Front office called Dan Ruoff, Henry Rotor, and <br />Tony Allegre. Everyone had gone home, but Tony Alegre will return to facility for <br />complaint investigation. <br />- 5:00 PM <br />02/25/2020 Discussed complaint with Elianna Florido (REHS at EHD), Elena Manzo (Lead <br />Senior REHS at EHD, and Muniappa Naidu (Program Coordinator at EHD). Front <br />desk received anonymous complaint that oily substances was going into the storm <br />drain that leads into a retention pond at 5100 W HVVY 12 in Lodi. <br />Received CERS environmental contact information and map of site. <br />Prepared PPE and left EHD. <br />Recorded by <br />MURO <br />MURO <br />MURO <br />02/26/2020 Met with Tony Allegre (facility owner) and Claudia Muro (with EHD) at the EHD's MANZO <br />office. Tony stopped by to discuss spill clean up and wanted to know why they <br />need to address the spill from something that is typically applied to land as a form <br />of dust control. Explained spill response and hazardous waste characteristic <br />determination procedures. <br />02/26/2020 Assisted Claudia Muro with ER response, reviewed SDS, participated in a MANZO <br />conference call with Claudia Muro and responsible party; discussed required clean <br />up action for the spilled material and the impacted storm drain. <br />5105. rpt Page 2 of 6
