Amended the Notice to MURO <br />Abate. Emailed the amended Notice to Abate to Henry Rotor at: <br />Henry@alegretrucking.com <br />02/26/2020 Henry Rotor, 209-810-5209, called to report that the spilled oily substance was not MURO <br />oil. It was a product used for dust control. I requested an SDS Sheet of the <br />product.. <br />Henry emailed the SDS sheets for the product they use for dust control. He said <br />there are two, 1) Magnesium Lignosulfonate Solution, Intermediate, and Heavy; <br />and 2) Plaza 48% Solids Red Liquor. Henry said the Plaza 48 `)/0 is premixed into <br />the Magnesium Lignosulfonate. <br />Reviewed the SDS sheets, and found they exhibit toxicity to fish. <br />I called SJ Valley Air Pollution Control, (209) 557-6400 and spoke to supervisor, <br />James Sanders. I provided spill information. I told him the facility provided SDS <br />sheet for the chemical name Magnesium Lignosulfonate Solution which shows <br />toxicity to fish. James Sanders told me he will research will get back to me. <br />11:58 PM Received call from Robert Fowler (co-owner of Frank C Alegre <br />Trucking) 209-334-2112. He wanted to know why they have to take measures <br />such as sampling and cleanup of the storm line since the material is 'organic' and <br />used on the ground. I explained that the reason a sample will have to be analyzed <br />is to confirm their claim that it is non-hazardous. I explained that the SDS sheet for <br />the Magnesium Lignosulfonate Solution provided by Henry Rotor shows it exhibits <br />toxicity to fish. He indicated they do not have fish so he doesn't understand why all <br />is necessary. I referred him to Elena Manzo and provided her phone number. <br />2:08 PM Tony Alegre (Frank C. Alegre Trucking) came to EHD office and met with <br />Elena Manzo (EHD) and I. He wanted clarification since he was having a difficult <br />time understanding how something that is applied to the ground for dust control, <br />was considered hazardous. Elena Manzo explained to Tony Alegre that the <br />chemicals they used are considered hazardous because they exhibit aquatic <br />toxicity. Elena Manzo discussed that they will need to perform cleanup of the <br />chemical, and that we will need to verify adequacy. <br />02/27/2020 Co-inspection with Claudia Muro (lead inspector). The facility was able to lift the <br />storm drain cover for us to inspect it; it was full of dry debris — no spilled material <br />was present, minor staining was visible inside the storm drain sidewall. Surface <br />staining was cleaned up using absorbent; all waste was containerized and placed <br />onside pending profiling and disposal. Clean up was deemed adequate. The <br />spilled dust control chemical application was halted pending further research by <br />the facility into it's application. See C.
