Provide a corrective action statement to the San Joaquin County Environmental Health Department <br /> (EHD)within 30 days. <br /> This is a minor violation. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: <br /> 1.A used oil spill was found on top of, and running down the front side of,the first used oil container, and on the <br /> ground,that was not been cleaned up. <br /> 2. Used oil stains were observed on the ground underneath the second used oil container, that were not cleaned up <br /> adequately. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by a facility employee,who cleaned up <br /> the spill and stains using absorbent and placed the absorbent inside an on-site hazardous waste drum. No further <br /> action is required to correct this violation. <br /> This is a Class II violation. <br /> 605 CCR 66262.34(f) Failed to completely label containers or portable tanks of hazardous waste. <br /> OBSERVATION: Hazardous waste containers were observed on-site with incomplete labeling. The containers <br /> were: <br /> 1.A 55-gallon drum storing oily absorbent was missing the accumulation start date. Mark McKinley, Manager, <br /> stated the last time the oily absorbent was hauled off site was on 7/7/2021 and waste was placed in the drum on the <br /> next day by marking the accumulation start date as 7/8/2021.An oily absorbent manifest dated 7/7/2021 was not <br /> observed at the time of inspection. <br /> 2. Two 220-gallon containers storing used oil was inaccurately labeled as liquid ethylene glycol solution. Mark <br /> accurately labeled the used oil containers as used oil. <br /> 3.An orange 5-gallon bucket storing used oil was missing the words"Hazardous Waste", name and address of <br /> generator, hazardous properties, physical state, composition (contents), accumulation start date.A facility employee <br /> emptied the used oil from the bucket into a properly labeled 220-gallon used oil container. <br /> REGULATION GUIDANCE: All hazardous waste containers shall be marked with the following information: the <br /> words"Hazardous Waste", name and address of generator, hazardous properties, physical state, composition <br /> (contents), accumulation start date. <br /> CORRECTIVE ACTION: Immediately label the containers as required for hazardous waste and provide an oily <br /> absorbent manifest dated 7/7/2021.
