S A N J 0 A Q I I I Irl Environmental Health Department <br /> C O U N T AMENDED <br /> 8/11/2021 <br /> Large Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> O'Reilly Auto Parts#3460 1210 N Tracy Blvd,Tracy July 16, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 608 CCR 66266.130 Failed to properly manage used oil filters or fuel filters. <br /> OBSERVATION: Containers of used metal oil or fuel filters out of compliance with the storage rules were observed <br /> on-site. The following used metal oil or fuel filter containers were on-site: <br /> 1.A 55-gallon drum of used metal oil filters was open, missing the accumulation start date, and containing used oil <br /> in the bottom of the drum. <br /> 2.A 55-gallon drum of used metal oil filters was improperly labeled as"drained non-metal (paper,fiber, or plastic) <br /> used oil cartridge filters and fuel filters only"and missing the accumulation start date. <br /> Mark McKinley, Manager, closed the open drum and stated the last time the used metal oil filters were hauled off <br /> site was on 7/7/2021 and waste was placed in the drums on the next day by marking the accumulation start date as <br /> 7/8/2021.A consolidated manifest receipt for used oil filters dated 7/7/2021 was not observed at the time of <br /> inspection. <br /> REGULATION GUIDANCE: <br /> Title 22 California Code of Regulations section 66266.130 Management of Used Oil Filters. <br /> California Health&Safety Code section 25250.22 Fuel Filters <br /> CORRECTIVE ACTION: Immediately drain all metal oil and fuel filters of free-flowing liquid, store them in closed, <br /> rainproof containers. Label the container with the words"drained used oil filters"or"used gasoline filters", <br /> depending on the contents. Provide a consolidated manifest receipt for used oil filters dated 7/7/2021 or mark the <br /> containers with an accurate accumulation start date. Dispose of all used filters stored on-site greater than one year. <br /> Used filters not stored, handled and disposed of according to this section are regulated as hazardous waste. <br /> Provide a corrective action statement, disposal records and supporting documentation to the San Joaquin County <br /> Environmental Health Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection. A complete report was <br /> amended and finished on 8/11/2021 and replaces the initial checklist. The inspection report was amended by <br /> adding violation 115 and removing violation 403. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 9/10/2021. <br /> Notes: <br /> -OBSERVATION: The following open hazardous waste storage containers were observed on-site: 1. An orange <br /> 5-gallon bucket storing used oil, located in the north-east corner of the facility, 2. A black 55-gallon drum storing <br /> oily absorbent, located in the north-east corner of the facility. <br /> REGULATION GUIDANCE: A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: The minor violation was corrected during the inspection by facility employees who <br /> closed the hazardous waste containers.
