State Guidelines and Regulations -40 CFR Part 112.76) 03 <br />There is a State of California law that applies to aboveground tanks that contain petroleum: <br />the California Aboveground Petroleum Storage Act (APSA) in the California Health and <br />Safety Code Section 25270 (H&SC 25270). The APSA requires that facilities complete a <br />SPCC Plan per the 40 CFR 112 requirements, perform monitoring to detect releases, and pay <br />biennial storage statement fees to the State of California if the aboveground quantities of oil <br />onsite are in excess of the SPCC Plan requirements in 40 CFR 112. <br />Qualified Oil -filled Operational Equipment -40 CFR Part 112.7(k) <br />Sufficient equipment or structures are available to prevent discharged oil from reaching <br />navigable waters or adjoining shorelines. Therefore, an oil spill contingency plan as <br />described in 40 CFR 109 is not required or included in this SPCC Plan, and 40 CFR 112.7(d) <br />or 40 CFR 112.7(k), the non -practicability of secondary containment of the SPCC regulations <br />does not apply to the Facility. <br />28 Mav 2017Aueust 2016 <br />
