On December 30, 2009, a permit application, SR0059054, was submitted for the 87- <br /> octane piping sump interstitial sensor that was replaced during the December 28, 2009, <br /> UST inspection. This permit was approved by Ms. Henry on January 4, 2010 <br /> (Attachment 34). <br /> On January 19, 2010, a permit application, SR0059183, was submitted to replace a <br /> vacuum float sensor in the 91-octane piping sump. This permit was approved by Ms. <br /> Henry on January 29, 2010 (Attachment 35). <br /> On February 17, 2010, Ms. Henry witnessed the testing of the vacuum float sensor in the <br /> 91-octane piping sump. The service technician was able to troubleshoot and retest the <br /> sensor to show it was operational and did not have to replace it. Ms. Henry also <br /> witnessed the testing of the diesel leak detector at the automobile side of the facility, <br /> which was two months past due, and the overfill prevention for both diesel tanks at the <br /> truck stop side of the facility, which were four months past due. Fuel was found in both <br /> diesel piping sumps at the truck stop side and the diesel south fill sump sensor had been <br /> in a "fuel alarm" since January 21, 2010, and had not been addressed (Attachment 36). <br /> On February 23, 2010, Ms. Henry sent a follow up letter regarding the October and <br /> December 2009 UST and hazardous waste inspections (Attachment 37). Ms. Henry had <br /> not heard from Mr. Gill regarding the October 2009 inspections since December 2, 2009, <br /> and nothing from the December 2009 inspections had been submitted or addressed. <br /> On March 8, 2010, Mr. Gill called Ms. Henry and asked if he can meet her at the EHD <br /> office to submit the return to compliance documents. An appointment was scheduled for <br /> 9:00 a.m. on March 22, 2010. <br /> On March 22, 2010, Ms. Henry waited for Mr. Gill to arrive for the scheduled <br /> appointment. When Mr. Gill did not arrive for the scheduled appointment by 9:15 a.m., <br /> Ms. Henry called and left a message for Mr. Gill asking him to return her call. Mr. Gill <br /> called back and left a message at 12:55 p.m. stating he thought the appointment was for <br /> the following day. Ms. Henry returned Mr. Gill's call and explained to him that they could <br /> schedule another appointment. Mr. Gill stated that he had been sick, and he would call <br /> Ms. Henry to schedule another appointment. Mr. Gill never called back. <br /> On October 27, 2010, Ms. Tran performed a routine UST inspection (Attachment 38) and <br /> witnessed the annual monitoring system certification, leak detector testing, and spill <br /> container testing on the truck stop side of the facility (Attachment 39). The diesel north <br /> fill sump sensor failed, diesel was found in both diesel piping sumps, diesel was found <br /> weeping in all dispensers at the union above the impact valve, and liquid was found in <br /> five UDC sumps. The smart sensors (S1 through S4) were not tested due to access <br /> issues. During a review of the facility's paperwork, Ms. Tran found that the annual <br /> permit fees had not been paid, and therefore the facility did not have a permit to operate <br /> the UST system in 2010. Current financial responsibility documents were not on file with <br /> the EHD, current copies of the monitoring and response plans were not found on site, <br /> and recordable and reportable release documentation was not performed for two leaks <br /> found in October and December 2009. The February 26, 2010, designated operator <br /> monthly inspection report indicated that the '15 diesel south fill sump is currently in <br /> alarm." Per the monitoring panel's alarm history, that sensor had been in alarm since <br /> January 21, 2010. No work orders or other documentation was found that show how this <br /> alarm was responded to in the facility's records, including the March 2010 designated <br /> 8 <br />
